The document stated: In recent times, the Government and the Prime Minister have resolutely directed ministries, branches and localities to implement solutions to completely handle long-standing backlog projects, revive and put into operation many large-scale projects, contributing to promoting socio-economic development in localities. However, there are still many works and projects that have not been promptly resolved by authorities at all levels, branches and agencies, causing backlogs and prolonged construction suspensions, causing waste of state and social resources.

In order to focus more on effectively, feasibly and decisively resolving the problems, promptly completing and putting into use backlogged projects and works, and stopping construction for a long time across the country, Deputy Prime Minister Nguyen Hoa Binh, Head of the Steering Committee for resolving difficulties and problems of backlogged projects (Steering Committee 751) requested ministries, agencies under the Government, People's Committees of provinces and centrally run cities to continue reviewing and updating information on projects with difficulties and problems on the database system of Steering Committee 751 (System 751); take full responsibility before the Government and the Prime Minister in case of omission, and backlogged projects, difficult problems and obstacles are not included in the report list as required by Steering Committee 751.
At the same time, ministries, branches and localities carefully study the provisions of current laws and specific policies stated in Resolution No. 170/2024/QH15 dated November 30, 2024 of the National Assembly . On that basis, urgently review and identify all projects with legal situations similar to Resolution No. 170/2024/QH15, propose competent authorities to allow similar application to resolve each specific policy group of Resolution No. 170/2024/QH15, synthesize and send to the Steering Committee on system 751 by August 10, 2025, noting:
- Review and propose only projects with difficulties and problems after having inspection, examination and judgment conclusions.
- Compare project issues to accurately determine the legal situation similar to the case specified in Resolution No. 170/2024/QH15, clearly stating the proposed provisions to apply specific mechanisms to resolve each specific project.
- Take full responsibility before the Prime Minister if there are any difficulties or problems with projects similar to the projects in Resolution No. 170/2024/QH15 after the above-mentioned deadline.
The Deputy Prime Minister requested that for projects that do not apply the specific mechanism in Resolution No. 170/2024/QH15 to remove difficulties and obstacles, the responsible agencies and organizations must review and clearly identify cases where the draft Outline of Solutions to Remove Difficulties and Obstacles of Steering Committee 751 can be applied to handle backlogged projects.
In case other solutions need to be added, it is recommended to study and propose specific solutions for each project, ensuring that they are suitable for the practical situation, in which the solutions clearly state legal problems and specific handling authority.
The review results will be reported to Steering Committee 751 before August 15, 2025 for synthesis and submission to competent authorities for comments on the policy of issuing Resolutions on the mechanism for handling difficulties and obstacles for the project.
Establish a Working Group to review and remove difficulties and obstacles for long-standing projects in the locality.
The Deputy Prime Minister requested the People's Committees of provinces and centrally run cities to establish a Working Group to review and remove difficulties and obstacles for long-standing projects in the localities, which will be directly directed by the leaders of the People's Committees of provinces and centrally run cities, to study viewpoints, principles, and legal situations to consider and propose projects to apply the mechanism to remove difficulties and obstacles according to the provisions of Resolution No. 170/2024/QH15 and Conclusion No. 77-KL/TW of the Politburo.
At the same time, build a timely coordination mechanism with Steering Committee 751 to propose solutions to remove difficulties and obstacles beyond authority; ensure progress, accurate data information, and promptly report the results of the removal to the Prime Minister and Steering Committee 751.
Draft Outline of solutions to remove difficulties and obstacles proposed by Steering Committee 751:
The group of solutions for projects with planning difficulties and problems includes 2 solutions:
Solution No. 01 - For projects without full planning;
Solution 2 - For projects that violate the planning overlap.
The group of solutions for handling BT projects includes 8 solutions:
Solution 1- For BT projects with contracts signed in accordance with regulations;
Solution 2- For BT projects with shortcomings in the investment preparation process;
Solution 3- For BT contracts with inappropriate content but can be amended and supplemented;
Solution 4- For BT projects with inappropriate BT contract content that cannot be modified or supplemented;
Solution 5- For BT projects that have signed BT contracts but have not yet implemented investment in construction of BT works;
Solution 6- For BT projects with increased total investment;
Solution 7- Handling cases where investors pay in advance to clear the land fund;
Solution 8- Allow the application of new regulations on BT contract types in the PPP Law to handle problems for transitional BT projects.
The Draft Outline also provides solutions to resolve cases where a project is in accordance with urban planning, land use planning and related planning approved by a competent state agency, but has been implemented without ensuring the conditions for starting construction according to the provisions of the construction law, and where the project has been decided, approved or permitted for investment by a competent state agency, and the investment location has been approved, but the investor or project owner does not go through an auction of land use rights or bidding to select an investor.
