TPO - On the afternoon of June 13, the
National Assembly Standing Committee gave opinions on the Draft Law amending and supplementing a number of articles of 4 projects: Land Law, Housing Law, Real Estate Business Law, and Law on Credit Institutions.
According to the submission,
the Government proposed allowing the Land Law, Housing Law, and Real Estate Business Law to take effect from August 1 instead of January 1, 2025. The Government believes that allowing the Land Law to take effect earlier will unlock resources, unleash potential, maximize the value of land resources, and meet the expectations and aspirations of localities, businesses, and people. In addition, many policies in the Housing Law and Real Estate Business Law can also be implemented immediately without detailed instructions. When the effectiveness of the Real Estate Business Law changes, it is necessary to amend the effectiveness of the Law on Credit Institutions. This is to ensure the synchronous application of legal regulations and strict assurance when receiving collateral from credit institutions.

Regarding the transitional provisions in the Land Law, Housing Law and Real Estate Business Law, the Government has directed the Ministry of Information and Environment and
the Ministry of Construction to review and assess the impact of any problems that may arise. The Government also assigned agencies to have appropriate plans to institutionalize them in the law, in order to ensure that there are no difficulties or problems in the management of land, housing and real estate markets; and to ensure the rights and interests of organizations and individuals when participating in relations related to land, housing and real estate markets. Regarding the progress of drafting documents, the Government affirmed that there is a sufficient basis for the documents detailing and guiding the implementation of the law to ensure progress and quality for implementation when these laws take effect from August 1.

According to him, the Government has made great efforts to complete the draft law. Along with that, the
Economic Committee has been very responsible, objective and comprehensive, examining many issues that need to be implemented, ensuring the feasibility of the law. At the same time, expressing its support for the policy of bringing the 4 laws into life soon. Through discussion, the Standing Committee of the National Assembly agreed to submit to the National Assembly for consideration and decision the Law amending and supplementing a number of articles of the Land Law, the Housing Law, the Real Estate Business Law, and the Law on Credit Institutions. The Standing Committee also requested the Government to promptly issue instructions to ministries, branches and localities to issue guiding documents, ensuring quality, progress, and fully preparing the conditions for the implementation of the law from August 1, 2024. Along with that, carefully review the transitional provisions to ensure consistency, synchronization, feasibility, no overlap, and no contradiction within the laws, between the laws and the legal system; “The Government needs to commit and take full responsibility before the National Assembly and the people for the effectiveness of adjusting the effective date and transitional provisions of the laws as explained in the Government's submission,” Mr. Hai stated.

On the other hand, the Standing Committee of the National Assembly also noted that it is necessary not to create legal or legal gaps or to allow negativity, policy exploitation, legalization of violations, and group interests. At the same time, it is necessary not to cause obstacles, congestion, or difficulties for localities, people, and businesses, or to hinder development; it is necessary not to create negative legal effects, affecting the rights of affected subjects, leading to social reactions, complaints, lawsuits, and affecting security, order, and social safety. The Vice Chairman of the National Assembly requested the Government to study and fully absorb the opinions of the members of the Standing Committee of the National Assembly, the opinions of the examining agencies, and complete the draft law dossier to send to the National Assembly. The Economic Committee, in coordination with the Law Committee and the examining agencies, will officially submit it to the National Assembly for consideration and decision at the 7th session according to the 1-session process. The Secretary General of the National Assembly is assigned to prepare a report to the National Assembly to adjust the meeting agenda, arrange time to present to the National Assembly, discuss in groups, discuss in the hall, and vote to approve this content.
