According to Decree No. 165/2024/ND-CP effective from January 1, 2025, 4-wheeled motorized passenger vehicles (electric tourist vehicles) are only allowed to operate on roads with a maximum speed sign of 30km/h. Meanwhile, in Da Nang, there are very few roads with this sign installed. Therefore, recently, some businesses have temporarily suspended electric vehicle operations.
In response to the business's feedback, on June 16, the Department of Transportation and Labor Safety (Department of Construction) said that the recent suspension of the operation of electric tourist vehicles was in accordance with regulations. Specifically, according to Clause 1, Article 34 of the Law on Road Traffic Order and Safety, the 4-wheeled electric vehicles with engines currently used to transport people in Da Nang are not considered automobiles according to regulations.
In 2016, Da Nang city was allowed by the Prime Minister to pilot the use of 4-wheel electric vehicles to transport tourists within a narrow area. 85 vehicles were invested in by 4 enterprises and put into operation before 2017 and 15 vehicles were invested in by 2 enterprises (out of the 4 pilot enterprises above) in December 2024.
During the pilot phase, the City People's Committee and local authorities always create the best conditions for businesses to operate. Because this is a pilot type of transport, this type of vehicle operates within a limited scope, so the City People's Committee and the Department of Transport (now the Department of Construction) "do not direct or call on businesses to invest in additional vehicles".
According to the Department of Construction, recently, based on the assessment of the pilot activities of the Ministry of Transport (now the Ministry of Construction ) and the opinions of relevant ministries, branches and localities... The Government requested the People's Committees of provinces and cities to announce that they will only implement the pilot regulations until December 31, 2024. From January 1, 2025, the operation of 4-wheeled motor vehicles will be carried out in accordance with the provisions of the Law on Road Traffic Order and Safety, the Road Law and detailed regulations.
Therefore, to find a way out as well as provide guidance for electric vehicle businesses in the area, the Department of Construction said that the Government has recently issued detailed regulations and guidelines for the implementation of a number of articles of the Road Law and Article 77 of the Law on Road Traffic Order and Safety. Accordingly, Clause 2, Article 24 of Decree No. 165/2024/ND-CP stipulates:
"From February 15, 2025: For 4-wheeled motor vehicles, they will only operate on routes with signs indicating a maximum operating speed of 30km/h, applicable to all vehicles. For 4-wheeled motor vehicles, they will only operate on routes with signs indicating a maximum operating speed of 50km/h, applicable to all vehicles. The provincial People's Committee is responsible for organizing the inspection and strict supervision of the schedule, time and scope of operation of 4-wheeled motor vehicles in accordance with the provisions of law."
At the same time, according to the Traffic Police Department, the actual operation of four-wheeled motor vehicles still has some limitations and shortcomings that affect the security and order situation in general and traffic safety in particular. To solve this problem, the offices of the People's Committees of provinces and centrally run cities shall preside over and advise on strict and correct implementation of the provisions of the law and Decree No. 165/2024/ND-CP on management and control of the operation of four-wheeled motor vehicles. "Thus, the conditions related to the transportation of passengers and goods by four-wheeled motor vehicles have been regulated and guided in detail by the Government," the Department of Construction informed.
Regarding the placement of speed limit signs, according to the Department of Construction, in accordance with the provisions of the law on road signs and based on the actual conditions of the route, the department and local state management agencies always acknowledge the contribution of road transport businesses to the economic and tourism development of the city; at the same time, share some difficulties of businesses when having to change the operating range of 4-wheeled motorized passenger vehicles.
However, in order to achieve the city's sustainable development goals, activities related to four-wheeled motor vehicles must ensure that they do not affect or conflict with other types of vehicles participating in traffic, especially the normal travel activities of the majority of people.
