Ho Chi Minh City applies an 'unprecedented' mechanism to resolve stalled projects.

TPO - Ho Chi Minh City has requested businesses to urgently review public investment, private investment, and PPP projects that are facing obstacles but are not yet included in the list of 838 projects previously compiled by Ho Chi Minh City, and update the obstacles on System 45.

The Ho Chi Minh City Real Estate Association (HoREA) has just issued an urgent document requesting businesses to promptly update the information on projects facing obstacles on the Department of Finance's System 45 before 3 PM on May 24th. This is considered a crucial review for Ho Chi Minh City to compile and address long-standing stalled projects and avoid overlooking any files.

According to HoREA, the organization has received a document from the Ho Chi Minh City Department of Finance requesting businesses to review public investment, private investment, and PPP projects that are facing difficulties but are not included in the list of 838 projects that Ho Chi Minh City had previously compiled.

Units are required to log into the "System 45" to declare details of each project using the available form, including the full name of the construction, project, and implementation location, without abbreviations. Businesses must also specify which stage is causing the problem and which agency is responsible for resolving it.

The Department of Finance notes that data, once submitted, cannot be edited, supplemented, or withdrawn, so units are solely responsible for the accuracy and truthfulness of the information before submitting it to the system.

Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association (HoREA), stated that all official data for reporting to the Ho Chi Minh City People's Committee will be extracted directly from System 45. Even departments, localities, or businesses that previously submitted separate reports to the Department of Finance are required to re-enter all data into the new system. The Department of Finance also affirmed that it will not be responsible for compiling data for cases where the required data entry is not completed.

According to the announcement, the system will only be open to receiving data until 3 PM on May 24th. After this time, the Department of Finance will stop accepting information about difficult and problematic projects in Ho Chi Minh City.

The Ho Chi Minh City Department of Finance stated that the development of System 45 aims to avoid the situation where "projects are still stalled but not included in the overall plan." Ho Chi Minh City currently wants to review all bottlenecks, from investment policies, planning, land allocation, determination of land use fees to the issuance of certificates to customers.

Representatives from the Department of Finance requested that businesses describe the project's "bottlenecks" as specifically as possible, instead of just stating them in general terms. Only after clearly categorizing each issue can the city assign the correct agency to handle it, instead of letting the files go through a lengthy process as before.

Earlier, at the conference to implement Directive 45 on May 13th, Mr. Le Hoang Chau called this the "last chance" for businesses to proactively review projects still facing legal obstacles. According to Mr. Chau, this review is taking place in the context of the Central Government and Ho Chi Minh City strongly promoting the handling of long-standing stalled projects to unlock resources for economic growth. A series of new mechanisms have been issued in a short period, such as Resolution 29 of the National Assembly, Decree 147 of the Government, and Directive 45 of the Ho Chi Minh City People's Committee.

Mr. Chau assessed that many of the new regulations are unprecedented, allowing for the handling of stalled projects in a way that facilitates businesses in rectifying violations and restarting projects. In some cases, a mechanism for temporarily suspending or halting investigations is even applied to allow time to address outstanding issues.

According to HoREA's statistics, the list of 838 outstanding projects includes various groups such as private investment, PPP, public investment, public assets, and projects related to inspection, investigation, and litigation. The private investment group alone comprises 265 projects, of which 62 have had their issues completely resolved and 130 have been deemed to have had their obstacles largely cleared.

“Ho Chi Minh City currently views the removal of stalled projects as an urgent task to unlock resources for double-digit growth targets starting this year. According to him, this is a “very special opportunity” as a series of new mechanisms have been issued in a short period of time with a spirit of faster and stronger handling than before,” Mr. Chau said.

Citing Resolution 29 of the National Assembly and Decree 147 of the Government, the Chairman of HoREA assessed that many regulations this time allow for the handling of stalled projects in a way that facilitates businesses in rectifying violations and restarting projects.

Mr. Chau also mentioned a series of mechanisms such as not prosecuting criminal responsibility in some cases, temporarily postponing or suspending investigations, and giving 3-5 years to rectify shortcomings. According to him, the new regulations reflect a spirit of "humanity, creating opportunities for recovery."

According to Directive 45 of the Ho Chi Minh City People's Committee, the Department of Finance is tasked with coordinating with relevant units to complete the review and propose solutions for outstanding projects within this June. Ho Chi Minh City also demands stricter accountability and severe penalties for cases causing delays in processing applications.
