(Chinhphu.vn) - The Ministry of Science and Technology is drafting a Decree detailing a number of articles of the Law on Atomic Energy on the development and application of atomic energy.

Developing nuclear science and technology potential, strengthening facilities for research and application of science and technology in the field of atomic energy

The Ministry of Science and Technology said that on June 27, 2025, at the 9th session, the 15th National Assembly passed the Law on Atomic Energy (amended) No. 94/2025/QH15, effective from January 1, 2026.

To ensure the feasibility and enforceability of the Atomic Energy Law from the time it comes into effect, it is necessary to promptly issue detailed Decrees.

The draft Decree is developed from the viewpoint of ensuring compliance with the Constitution and relevant legal provisions. The detailed provisions must be consistent with the spirit and content of the 2025 Law on Atomic Energy, ensuring constitutionality, legality, consistency, synchronization and feasibility in practical implementation.

Ensuring simplicity, transparency, ease of understanding, ease of implementation, facilitating organizations and individuals operating in the field of atomic energy, contributing to promoting decentralization, delegation of authority, administrative procedure reform, and digital transformation.

Overcome the limitations of regulations that have had difficulties and obstacles in practical application in recent times; ensure that new regulations originate from practical requirements and promptly meet the development needs of the nuclear energy industry in the new period.

Prioritize investment and diversify capital sources for development and application of nuclear energy.

According to the draft, priority given to the development and application of nuclear energy must ensure the following principles:

The contents have been regulated by the State to ensure budget or investment with State capital according to the provisions of relevant laws.

In accordance with or approved in the strategy, planning and development plan, application of atomic energy approved by competent authority.

Priority is given to projects, programs, plans, and tasks in the list of high technologies prioritized for investment, and projects implemented in areas identified as having difficult or especially difficult socio -economic conditions according to the provisions of law.

Investment priority content:

Construct and operate nuclear power plant projects; develop nuclear science and technology potential, strengthen facilities for research and application of science and technology in the field of atomic energy; develop strategic technologies, including the development of nuclear reactor technology.

Building, operating, maintaining and developing a digital platform on radiation safety, nuclear safety and nuclear security, developing and applying atomic energy; building and operating a national environmental radiation monitoring and warning network.

Building a national-level site for storing, processing, and burying radioactive waste, spent radioactive sources, and spent nuclear fuel; building a provincial-level site for storing, processing, and burying radioactive waste.

Strengthening technical facilities, equipment and laboratories for research and training facilities in the field of atomic energy; synchronously developing infrastructure, culture, education, health care and social welfare in localities with nuclear facilities.

Implementing the national science and technology and innovation program on development and atomic energy

Diversify capital sources:

The central and local budgets ensure capital sources to develop nuclear science and technology potential, strengthen facilities for research and application of science and technology in the field of atomic energy; develop strategic technologies, including the development of nuclear reactor technology; build, operate, maintain and develop a digital platform on radiation safety, nuclear safety and nuclear security, develop and apply atomic energy; strengthen facilities - techniques, equipment and laboratories for research and training facilities in the field of atomic energy.

Use legal funds and capital sources of enterprises and organizations to develop nuclear science and technology potential, strengthen facilities for research and application of science and technology in the field of atomic energy; build, operate, maintain and develop a digital platform on radiation safety, nuclear safety and nuclear security, develop and apply atomic energy; build a place to store, process and bury radioactive waste at the provincial level when there is an urgent need to serve assigned tasks according to regulations on management of state capital invested in enterprises and other relevant legal provisions.

Ensure budget for research and technology development in the field of atomic energy

The draft clearly states that the state ensures the allocation of the state budget to carry out scientific research, technology development and innovation activities in the field of atomic energy, including:

a- Science, technology and innovation tasks at all levels.

b- National science, technology and innovation program on development and application of atomic energy.

c- Strategic technological activities in the field of atomic energy, including controlled testing, technology decoding, purchasing technological know-how, technology transfer and other specific contents to localize and master nuclear technology.

d- Purchase design documents, technical documents, technological know-how, and sample products to organize research in accordance with the provisions of law on scientific, technological and innovation activities.

d- Constructing new, maintaining, repairing, and upgrading technical infrastructure to serve scientific research, technology development, and other technical and professional activities to ensure radiation and nuclear safety in the field of atomic energy.

e- Training, fostering, developing human resources for state management, research, implementation and technical support in the field of atomic energy.
