Proposal to extend service age for police officers in special cases
On the morning of May 27, Minister of Public Security To Lam, authorized by the Prime Minister, presented to the National Assembly a report on the draft Law amending and supplementing a number of articles of the Law on People's Public Security (CAND).
The construction of the Law aims to institutionalize the guiding viewpoint: "Building a revolutionary, disciplined, elite, and gradually modernized People's Public Security, with some forces advancing straight to modernity, creating a solid premise to strive by 2030 to build a revolutionary, disciplined, elite, and modern People's Public Security" in the Resolution of the 13th National Congress of the Party.
Ensure consistency and synchronization with regulations on increasing the retirement age of employees; overcome some difficulties and problems in the implementation of the Law on Public Security related to early promotion to the rank of General for Public Security officers with outstanding achievements in combat and work; specify some positions with the rank of General in the Public Security in accordance with Party regulations and work requirements.
The Draft Law consists of 2 articles: Article 1. Amending and supplementing a number of articles of the Law on Public Security and Article 2. Effective date with a number of notable contents.
Accordingly, the regulation stipulates that police officers who are considered for promotion from Colonel to Major General must have at least 3 years of service remaining. In case of less than 3 years of service, the President will decide. The Government will specify the criteria and standards for early promotion to the rank of General for police officers with outstanding achievements in combat and work.
Supplementing specific regulations on 6 positions with the highest rank of General in the People's Public Security, including: 1 position with the highest rank of Senior Lieutenant General and 5 positions with the highest rank of Major General; stipulating that the Chief of City Police of a centrally-run city and Regiment Commander have the highest rank of Colonel.
Supplementing regulations and increasing the maximum service age of police officers (males increase by 2 years, females increase by 5 years); increasing the age of officers and non-commissioned officers by 2 years; female officers with the rank of Colonel increase by 5 years, female officers with the rank of Lieutenant Colonel increase by 3 years; female officers with the rank of General remain at 60 years old as current; supplementing regulations to extend the maximum service age for police officers in special cases.
Age increase time according to the roadmap: Each year, increase 3 months for men and 4 months for women. For officers and non-commissioned officers with the highest service age under 60 years old for men and under 55 years old for women, the age increase is 2 years immediately, not following the above roadmap.
The time for increasing the maximum service age will start from 2021 but will not apply to cases that have retired from work before the effective date of this Law. The Government shall specify the roadmap for increasing the maximum service age of police officers, non-commissioned officers, and workers in accordance with the provisions of the Labor Code.
The current service age limit for non-commissioned officers and officers of the People's Public Security is stipulated in Article 30 of the 2018 Law on People's Public Security as follows:
- Maximum service age of non-commissioned officers and officers of the People's Public Security:
Non-commissioned officer is 45 years old.
Lieutenant is 53 years old
Major, lieutenant colonel is 55 years old for men and 53 years old for women
Lieutenant Colonel is 58 years old for men and 55 years old for women
Colonel for men is 60 years old and women is 55 years old
Generals have a retirement age of 60 years old.
Increasing the maximum service age of the People's Public Security Forces is appropriate.
Presenting the review report, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi stated that the Committee on National Defense and Security (QPAN) agreed with the necessity of promulgating a Law amending and supplementing a number of articles of the Law on People's Public Security.

The National Defense and Security Committee agreed with the Government's proposal to increase the maximum service age of police officers, non-commissioned officers, and workers and found that: Increasing the maximum service age of the People's Public Security force is consistent with the Party's policy of adjusting the retirement age in Resolution No. 28-NQ/TW, dated May 23, 2018 of the 12th Party Central Committee on reforming social insurance policies and consistent with the provisions of the 2019 Labor Code on retirement age; there is an inheritance of the age structure prescribed in the 2005, 2014, and 2018 Laws on People's Public Security.
However, some opinions say that raising the maximum service age for female Lieutenant Colonels to 3 years and female Colonels to 5 years is a significant increase, while most other ranks are increased by 2 years to suit the special working environment of the People's Public Security Forces.
The QPAN Committee also approved the regulations on the roadmap and timing of increasing the maximum service age from January 1, 2021. However, there were opinions suggesting considering the regulation on immediately applying a 2-year age increase for officers and non-commissioned officers with a service age of under 60 for men and under 55 for women.
Regarding the regulation on extending the service age as prescribed by the Minister of Public Security, the National Defense and Security Committee agrees with the provisions of the draft Law, because it believes that the extension of the age limit is appropriate, on the basis of inheriting the provisions of the current Law on Public Security and consistent with the regulations on increasing the service age limit, meeting the practical requirements of public security work. There are opinions that the extension of the age limit is under the authority of the National Assembly or the National Assembly assigns the Government to make specific regulations.
Regarding the regulation on special cases where the service age is extended beyond 62 years old for men and 60 years old for women, the National Defense and Security Committee agrees with the provisions of the draft Law, but there are some opinions suggesting specific regulations on special cases; the maximum age limit that can be extended and the age limit that can be extended must not exceed the roadmap for increasing the highest service age limit prescribed.
