Protecting national security, ensuring social order and safety in the new situation
Continuing the 5th Session, on the morning of June 20, the National Assembly listened to the Presentation and Verification Report on the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level.
Presenting the report, Minister of Public Security To Lam stated that the law is aimed at institutionalizing the Party's viewpoints and policies on consolidating, arranging, and streamlining internal focal points in conjunction with perfecting the functions, tasks, powers, and working relationships of each grassroots organization; reducing state budget expenditures; concretizing and creating a legal basis to ensure the implementation of the provisions of the 2013 Constitution on human rights and civil rights, meeting the requirements of protecting national security, ensuring social order and safety in the new situation.
The draft law aims to build and strengthen the movement of the entire people to protect security, order and social safety at the grassroots level, led by the Party, managed by the government and functional forces, in which the People's Public Security plays the core role; codify legal documents on forces participating in protecting security and order at the grassroots level to stipulate in legal documents, ensuring the consistency and unity of the legal system; create a more complete and appropriate legal basis for the construction, operation, management and use of forces participating in protecting security and order at the grassroots level, meeting the requirements of state management of security and order at the grassroots level.
The Draft Law consists of 5 chapters and 31 articles, stipulating the position, functions, tasks, principles of organization, operation, working relations, force building, ensuring operating conditions and responsibilities of agencies and organizations towards forces participating in protecting security and order at the grassroots level.

Minister of Public Security To Lam said that the draft law stipulates standards on background, educational level, and health of those selected to join the security and order protection force at the grassroots level, ensuring that they are suitable to practical conditions and security and order requirements of each region.
In addition, the law also regulates working relations with the People's Council, People's Committee, Commune-level Police and coordination relations with agencies and organizations located in the commune; prohibited acts related to the organization, operation, construction, and ensuring operating conditions for forces participating in protecting security and order at the grassroots level; regulations on the consolidation and unification of the civil defense force, the part-time commune police force that has completed its duties, and the positions of captain and deputy captain of the civil defense team into a force participating in protecting security and order at the grassroots level and arranged according to the model of security and order protection teams in villages, residential groups, and equivalent residential units...
Review regulations to ensure consistency and feasibility
Examining the draft law, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee on National Defense and Security basically agreed with the necessity of promulgating the law for the reasons stated in the Government 's Submission and basically agreed with the name and scope of the draft law submitted by the Government, because it had fully summarized and was relatively consistent with the content of the draft law, consistent with the goal of law-making.
The National Defense and Security Committee found that the draft law had been carefully prepared, meeting the requirements of the Law on Promulgation of Legal Documents, and was eligible to be submitted to the National Assembly for discussion and comments; and at the same time, it believed that the draft law thoroughly grasped the Party's policies and guidelines, and was consistent with the provisions of the Constitution and relevant laws.

However, Chairman Le Tan Toi also stated that because the content of the draft law is related to the functions and tasks of the People's Public Security force and a number of other relevant forces at the grassroots level, it is recommended to continue reviewing to ensure consistency in the legal system, ensuring strictness and feasibility when applying the law.
The National Defense and Security Committee basically agrees with the regulations on the position and functions of the forces participating in protecting security and order at the grassroots level as in the draft law and agrees with the selection criteria and application documents for the forces participating in protecting security and order at the grassroots level in Article 4, along with the regulations on examining documents and electing members of the Security and Order Protection Team in Article 13.
Regarding the working relationship and coordination of forces participating in protecting security and order at the grassroots level and mobilizing forces to protect security and order at the grassroots level (Article 5), the majority of opinions of the National Defense and Security Committee agree with the regulation according to the principle of being under the leadership and direction of the Party Committee, the management and operation of the government and the command and direction of expertise and profession of the Public Security agency.
In addition, the National Defense and Security Committee agreed with the need to specify the tasks of the force participating in protecting security and order at the grassroots level in the draft Law, and at the same time proposed to continue perfecting the regulations on tasks to suit the position and functions of this force.
The Committee also basically agreed with the draft law stipulating that the Ministry of Public Security is responsible to the Government for presiding over the implementation of state management of forces participating in protecting security and order at the grassroots level, while continuing to review specific contents on the responsibilities of ministries, branches, agencies, organizations and local authorities to absorb appropriately, ensuring consistency, rationality and feasibility.
Regarding ensuring operating conditions for forces participating in protecting security and order at the grassroots level, the majority of opinions agreed with the draft law and proposed to stipulate monthly (or quarterly) allowances for the Head and Deputy Head of the Security and Order Protection Team.
The National Defense and Security Committee believes that the level of assurance is still very limited compared to the requirements of the task. When perfecting and reorganizing the force, it is necessary to pay more attention to implementing the regime, policies, and conditions to ensure the operation of the force in order to motivate, encourage, and attract people to participate and meet the requirements of the assigned task.
Therefore, the National Defense and Security Committee recommends carefully evaluating and calculating the sufficient funding level that the state budget must ensure to meet task requirements, mobilize and encourage people to participate, in accordance with the spending capacity according to the provisions of the State Budget Law as a basis for the National Assembly to consider and decide.
