7 years and 6 months in prison sentence upheld for former Tay Ho District Police Chief Phung Anh Le

On the evening of April 20, the High People's Court in Hanoi concluded the appeal trial, upholding the 7-year and 6-month prison sentence for defendant Phung Anh Le for the crime of "Receiving bribes".

The trial was opened to consider the appeal of defendant Phung Anh Le (former colonel, former Chief of Tay Ho District Police, former Head of the Economic Police Department of Hanoi City Police).

Accordingly, the appellate court determined that based on the collected documents and evidence, the court had sufficient grounds to conclude that in 2016, former colonel Phung Anh Le, through his uncle Phung Van Bay, received 110 million VND to avoid criminal proceedings against Nguyen Huu Tai. Upon receiving the money, on the night of September 22, 2016, Mr. Le directed his subordinates to go to the detention house to take Tai out to write a guarantee and then release him.

With the above behavior, according to the panel of judges, the defendant's behavior violated public order and security, negatively affected the agencies conducting the proceedings..., so it needs to be severely punished. When considering the appeal, the panel of judges fully considered the evidence and mitigating circumstances provided by the family, and the panel of judges recognized that this was a new circumstance.

However, the sentence of 7 years and 6 months in prison imposed by the court of first instance was appropriate; during the trial, the defendant did not provide any new evidence related to the content of the case, so the appellate panel decided not to accept the defendant Le's appeal, upholding the original judgment, and sentencing him to 7 years and 6 months in prison. Regarding civil liability, the panel ordered the defendant to pay back the amount of 110 million VND.

At the appeal hearing, Mr. Phung Van Bay, when asked to testify about the incident, said he maintained his statement during the investigation. He said he gave 110 million VND to his nephew Phung Anh Le at his office and then left.

Meanwhile, before the appellate court, defendant Phung Anh Le maintained his appeal, claiming that he did not receive bribes and was not guilty. Mr. Le admitted that at the end of 2016, he was the Chief of Tay Ho District Police and was in charge of the unit; however, the defendant could not remember clearly the events of the night of September 22, 2016.

At the appeal hearing, defendant Le requested to collect the duty schedule that day because he could not remember clearly whether he was on duty or not, and he also denied the testimony of his uncle Phung Van Bay. Continuing to deny the accusation of accepting bribes, defendant Phung Anh Le asked to accept responsibility as the head of Tay Ho District Police when the incident occurred. However, regarding criminal responsibility, defendant Le said that whoever allowed the incident to occur must be held responsible.

Previously, in August 2022, defendant Phung Anh Le was sentenced by the Hanoi People's Court to 7 years and 6 months in prison for the crime of "Accepting bribes". In connection with the case, defendants Nguyen Duc Chau (former Criminal Police Team Leader of Tay Ho District Police) received 10 months and 28 days in prison (equal to the detention period); Vu Cong Ngoc (former Deputy Criminal Team Leader) received 6 months of suspended imprisonment, Le Dinh Trung (former Deputy Execution Team Leader) received 4 months and 12 days in prison, all for the crime of "Illegal release of arrested people, people being detained, temporarily detained, people serving prison sentences".
