5 forms of discipline for students who violate the rules are being applied in schools

NDO - There are 5 forms being applied in enforcing discipline on high school students who commit shortcomings in exercising their rights and duties, including: Reprimand in front of the class; Reprimand before the school's disciplinary council; Warning in front of the whole school; Expulsion for 1 week; Expulsion for 1 year.

Currently, disciplinary measures against high school students who commit violations are being implemented according to the nearly 40-year-old regulation, Circular No. 08/TT dated March 21, 1988 of the Ministry of Education guiding the commendation and discipline of students.

Accordingly, disciplinary action against high school students who commit shortcomings in exercising their rights and duties has 5 forms: Reprimand in front of the class; Reprimand before the school's Disciplinary Council; Warning in front of the whole school; Expulsion for one week; Expulsion for one year.

Reprimand in front of the class : Students who commit one of the following shortcomings in the process of implementing school regulations, authority and duties assigned to themselves will be reprimanded in front of the class:

Absent from school without permission for 3 or more sessions within 1 month; Not knowing or doing homework, not preparing lessons as prescribed by teachers for 3 or more times within 1 month; Not coming to school on time or going to work without bringing work tools as prescribed by the school for 3 or more times within 1 month; Using vulgar language, gambling (playing lottery), smoking, etc.;

Committing mistakes that are prohibited by the school, even if only once, but have a certain harmful effect on the school's comprehensive education such as: cheating or cheating on other students' papers during tests, having an uncultured attitude or unethical behavior towards teachers, parents, friends and people around, causing disunity in study groups, covering up or agreeing with wrongdoings of friends, not reporting to the school the wrongdoings of friends that you know about so that the school can take timely preventive measures, or reviewing other mistakes that have the same nature and level of harmfulness.

Reprimand before the school's Disciplinary Council : Students who commit one of the following shortcomings: Repeatedly committing one of the shortcomings or violations that have been reprimanded in front of the class; Committing shortcomings or violations that are prohibited by the school, even if only once, but causing many harmful effects that negatively affect the school's comprehensive education such as: stealing pens, books, money, personal belongings, etc. from friends, teachers, family or people where they live, quarreling, fighting with friends and people outside the school, spreading bad public opinion, spreading false rumors, participating in propaganda of superstitious activities, listening to music, watching movies or distributing newspapers and magazines with bad content, or committing other shortcomings or violations of similar nature and level of harm.

Warning to the whole school : Students who commit one of the following violations: Committing violations that have been reprimanded by the school's Disciplinary Council but refusing to correct them and still reoffending; repeatedly skipping school, skipping work or cheating on their classmates' papers during tests; committing major violations, even if only once, but with serious consequences such as: stealing or robbing inside and outside of school; speaking and acting disrespectfully towards teachers; teasing or behaving rudely towards women or foreigners; showing clear signs of disturbing public order and security; being temporarily detained by the police or notified to the school; fighting in an organized manner or committing other violations of a similar nature and level of harm.

Expulsion for one week: Students who commit violations that have been warned in front of the whole school but do not know how to repent and correct their mistakes, causing negative effects on other students; or commit violations for the first time but with serious nature and level, causing great damage to the honor of the school, teachers and the student body such as: theft, robbery, organized fighting and causing injury to others, ... or commit other violations of similar nature and level of harm, the school's Disciplinary Council will consider and propose to the Principal to decide and implement, and at the same time report to the direct superior educational management agency for information and monitoring.

This form of discipline will be recorded on the student's transcript and notified to the family for educational coordination.


During the 1-week period of expulsion, the student must review and think deeply about his/her shortcomings and mistakes. If he/she shows sincere repentance and is determined to correct his/her shortcomings and improve, then after the period of expulsion, the Principal may consider and decide to allow him/her to continue studying. The time the student is expelled from school will be considered as an excused absence if he/she is allowed to return to school.

If during the 1-week suspension, the student who committed the mistake does not show sincere repentance and determination to correct the mistake, and even commits more mistakes, the school's Disciplinary Council will propose to the Principal to decide to suspend the student for 1 year.

Expulsion from school for 1 year: Students who commit one of the following violations will be recommended by the school's Disciplinary Council to the Principal for a decision to be expelled from school for 1 year, with the case recorded in the school record and notified to the family, and at the same time handed over to the family, the Youth Union and the local government for continued education:

Having committed a mistake and been expelled from school for a week by the school's Disciplinary Council through the Principal, but not correcting it, still reoffending, even committing other mistakes and violations;

Committing a very serious mistake, even though it is only the first time, but this wrongdoing is conscious and proactive (not being enticed or accomplice), causing very great harm, very dangerous to the property of society and human life such as: participating in theft, robbery, depravity, reactionary organizations, ... using weapons (daggers, bayonets, pistols, grenades, ...) to fight in an organized manner, causing injury to others, being arrested by the police outside of school or committing other mistakes and wrongdoings of similar nature and level of harm.

In addition to the above disciplinary measures, to ensure the pedagogical nature and seriousness of teaching and learning during class hours, subject teachers may temporarily suspend students from studying and refer them to the Principal for education if they commit one of the following violations: speaking or behaving disrespectfully towards teachers; fighting with friends in class; causing disorder that affects the learning of the class, despite being advised and reminded by teachers.

Currently, the Ministry of Education and Training is seeking comments on the Draft Circular regulating rewards and discipline for students to replace Circular 08/TT.

According to the viewpoint of the Ministry of Education and Training in the Draft of the new Circular, disciplinary measures aim to prevent, stop and handle student violations. Discipline aims to educate and help students to be aware of their violations; to voluntarily adjust their behavior, overcome the consequences, voluntarily cultivate and practice to improve and form disciplined habits and lifestyles.

The principles when disciplining students are set out as "Respect, tolerance, objectivity, no prejudice, ensuring the right to participate and the interests of students in related issues" and "Do not use disciplinary measures that are violent, insulting to dignity, or affect the physical and mental health of students".
