Continuing the 6th session, on the afternoon of October 26, Chairman of the National Assembly 's Law Committee Hoang Thanh Tung reported on explaining, accepting and revising the draft Law on Housing (amended).
Regarding the regulation that the Vietnam General Confederation of Labor is the investor of social housing projects and worker accommodation in industrial parks (Clause 4, Article 80), Mr. Hoang Thanh Tung said that there are still different opinions on this content, the National Assembly Standing Committee reported 2 options.
Option 1: Accept the opinions of the Government and the Vietnam General Confederation of Labor in the direction of regulating the Vietnam General Confederation of Labor as the governing body of social housing investment projects for rent.
This not only adds resources to invest in social housing projects, contributes to improving and enhancing the quality of life for low-income workers and laborers, attracts workers to join the Trade Union, but also limits the scope of implementation (excluding worker accommodation in industrial parks) to improve feasibility.
Option 2: The Vietnam General Confederation of Labor is not stipulated as the investor of social housing projects in the Housing Law (amended) because this is a new issue, the pilot process in the past has had many problems, and is not "mature" enough to be stipulated in the law.
Propose that the Vietnam General Confederation of Labor develop a project to report to the National Assembly for consideration and decision to pilot the policy of the Vietnam General Confederation of Labor as the investor of social housing projects for a certain period of time. If it is effective, it will be stipulated in the law.
According to Chairman of the National Assembly's Law Committee Hoang Thanh Tung, the majority of opinions of the National Assembly Standing Committee agree with option 1.

Participating in giving comments on the Draft Law on the regulation that the Vietnam General Confederation of Labor is the investor of social housing projects and worker accommodation in industrial parks, delegate Nguyen Quoc Luan (Yen Bai delegation) expressed agreement with the regulation in option 1 of the draft Law.
Delegate Luan said that, in the context of limited state resources and enterprises not being interested in investing in social housing, the regulation that the Vietnam General Confederation of Labor invests in social housing is an effective way for workers to rent, promoting social development resources in accordance with the Party and State's policy on increasing resources for investment in social housing and housing for workers to improve living, working and living conditions, ensuring social security for workers.
He also suggested that the Vietnam General Confederation of Labor should have solutions to balance resources to ensure the feasibility of the investment project. At the same time, it is necessary to amend and supplement relevant regulations, creating a synchronous legal basis for the Vietnam General Confederation of Labor to have a basis for implementation.

Sharing the same view, delegate Nguyen Thi Viet Nga (Hai Duong delegation) also agreed to empower the Vietnam General Confederation of Labor to be the investor of social housing. According to her, this is a regulation with a very humane purpose; contributing to solving the current situation of ineffective social housing development and failure to attract investors.
However, according to Ms. Nga, the subjects allowed to rent social housing invested by the General Confederation should be expanded. Because when the project has completed construction investment and entered the rental operation phase, if only workers and laborers are allowed to rent, it will easily lead to a situation where workers and laborers do not have the need to rent all of them, and there will still be excess rental housing, while many other subjects have the need but cannot rent because they are not "workers and laborers".
Delegate Nguyen Huu Chinh (Hanoi delegation) also expressed his agreement with the plan to allow the Vietnam General Confederation of Labor to participate in investing in the construction of housing for union members who are beneficiaries of social policies and in industrial zones. However, he said that there should be specific regulations and a specific roadmap.
General Federation of Construction, who supervises?
Speaking at the debate on the issue of the General Confederation of Labor participating in the development of social housing, delegate To Van Tam (Kon Tum delegation) said that this is a new issue, and there are still many issues that need to be clarified in the implementation process.
He said that the Government has not thoroughly assessed the implementation of existing regulations, so it is necessary to have a thorough overall assessment to see if this issue is "ripe", clear, and has been tested in practice, thereby including it in regulations in a reasonable manner.
The delegate also said that assigning a State agency or a political or social organization to be the investor of a social housing project for sale or lease-purchase is not consistent with the requirement of separating the functions of a State agency, the functions of a political or social organization, and the functions of production and business.
Therefore, Mr. Tam suggested that it is necessary to consider carefully, not to include this content in the law, but to follow current decisions, synthesize practices to legalize "ripe" and clear content.

Delegate Hoang Van Cuong (Hanoi delegation) also debated the opinion of delegates agreeing to choose option 1, which is that the trade union organization is the investor.
Mr. Cuong said that this explanation is not satisfactory because the union represents the voice of the workers. At the same time, he expressed concern that when there is a housing problem, who represents the workers to speak up? “When there is a housing shortage, the union must also take responsibility,” Mr. Cuong said.
Therefore, delegate Hoang Van Cuong agreed to have the trade union be the investor in housing for workers, but suggested that these should only be model projects to serve as examples and for the trade union to have a voice with other agencies .
