The Hai Phong City National Assembly Delegation reported that on January 11, 2024, the Government issued Decree No. 03/2024/ND-CP regulating the agencies performing specialized inspection functions and the activities of agencies assigned to perform specialized inspection functions. Accordingly, Decree No. 90/2012/ND-CP dated November 5, 2012 of the Government on the organization and operation of inspection in the Home Affairs sector, which expired on March 1, 2024, was completely abolished.
Voters recommend that the Ministry of Home Affairs soon issue a new Circular guiding the process and content of inspection of the implementation of regulations on home affairs so that localities have a basis for implementation.
Regarding the above issue, the Ministry of Home Affairs said: Based on the 2010 Law on Inspection and Decree No. 90/2012/ND-CP, the Minister of Home Affairs issued Circular No. 09/2012/TT-BNV dated December 10, 2012 regulating the process and content of inspection on recruitment, use and management of civil servants and public employees.
However, up to now, some regulations need to be adjusted, replaced or abolished according to the 2022 Law on Inspection, the Law amending and supplementing the Law on Cadres and Civil Servants, the Law on Public Employees and guiding documents for implementation. The Ministry of Home Affairs has researched and planned to soon develop a Circular to replace and abolish Circular No. 09/2012/TT-BNV to ensure the legal basis for implementing specialized inspection activities for inspection agencies in the Home Affairs sector. In particular, the Ministry of Home Affairs will consult the Government Inspectorate on the necessity of issuing a specialized inspection process in the Home Affairs sector.
Taking note of the opinions of Hai Phong voters, the Ministry of Home Affairs informed that in the coming time, the Ministry of Home Affairs will consult the Government Inspectorate on that basis to consider and issue a Circular regulating the process and content of inspection of recruitment, use and management of civil servants.
Regarding the issuance and re-issuance of Medals and Medals sent by the National Assembly Delegation of Quang Tri province, the Ministry of Home Affairs said that 57 cases of request for issuance and re-issuance of Medals and Medals of Resistance War by the People's Committee of Trieu Phong district, Quang Tri province that have not been resolved are cases of issuance and re-issuance of Medals of Resistance War under the commendation authority of the Chairman of the Council of Ministers.
The above cases have been compiled by the People's Committee of Quang Tri province and submitted to the Central Emulation and Rewards Committee for consideration and resolution in 2016. The Central Emulation and Rewards Committee issued Notice No. 201/TB-BTĐKT and No. 202/TB-TĐKT dated July 26, 2017 on the results of the issuance, re-issuance, stating that the reason for not issuing, re-issuing the Resistance Medal is due to the suspension of stamping. Therefore, the issuance, re-issuance of the medal is temporarily suspended and not resolved.
When there is a new document guiding the exchange and re-issuance of degrees, the Central Emulation and Rewards Committee will notify ministries, departments, branches and localities, and at the same time return the original documents and degrees of unresolved cases to the Emulation and Rewards Committee of Quang Tri province.
After that, the Emulation and Reward Board of Quang Tri province issued Official Dispatch No. 60/TĐKT-NV2 dated May 21, 2019 to the People's Committee of Trieu Phong district to notify the results of granting, changing and re-granting for the above cases (with Notice No. 201/TB-BTĐKT and No. 202/TB-TĐKT dated July 26, 2017, Official Dispatch No. 60/TĐKT-NV2 dated May 21, 2019 of the Emulation and Reward Board of Quang Tri province attached).
Currently, implementing the provisions of Articles 114 and 115 of Decree No. 98/2023/ND-CP dated December 31, 2023 of the Government detailing the implementation of a number of articles of the Law on Emulation and Commendation, the Ministry of Home Affairs (Central Emulation and Commendation Committee) has been issuing and re-issuing Certificates of State-level emulation and commendation forms to promptly meet the needs and legitimate aspirations of the people. However, up to now, there are still some forms of emulation and commendation that have not been issued or re-issued Certificates of Merit, including the Resistance Medal under the commendation authority of the Chairman of the Council of Ministers because the legality of the signatures of the state leaders with the authority to sign the Certificates of Merit in previous periods has not been confirmed.
The Ministry of Home Affairs is continuing to coordinate with relevant agencies to soon have a legal basis for signature samples to serve the construction of Certificates of Merit for exchange and re-issuance in the above cases and will notify ministries, departments, branches and localities for implementation. In case individuals have not yet been resolved to exchange or re-issue Certificates of Merit and Resistance Medals, in order to promptly resolve policies for people with meritorious services to the revolution, the specialized agencies in charge of emulation and commendation at all levels are responsible for confirming the commendation information.
