The People's Committee of Can Tho City has just issued Decision No. 54/2026/QD-UBND stipulating the decentralization of authority to the Chairmen of the People's Committees of communes and wards to perform a number of tasks in the field of land in the city. This is considered an important step to concretize the policy of decentralization and delegation of power according to the two-tiered local government model, while also resolving difficulties and obstacles in the implementation of the Land Law.
According to the Decision, the Chairman of the People's Committee of Can Tho City at the commune level will be assigned to carry out a series of important tasks related to land acquisition, compensation, support, resettlement, land allocation, land leasing, permission to change land use purposes, recognition of land use rights, extension of land use time, and approval of land use plans in accordance with the law.

In the field of land acquisition, the Chairman of the People's Committee at the commune/ward level has the authority to decide on land acquisition in many cases as prescribed by the Land Law; issue land acquisition notices; decide on mandatory inventory; establish compensation, support, and resettlement councils; approve compensation, support, and resettlement plans; and simultaneously implement coercive decisions when necessary as prescribed by law.
Regarding land allocation, land leasing, and land-use conversion, commune-level authorities are empowered to decide on land allocation and leasing to individuals and communities; allocate land for resettlement; and permit land-use conversion in various cases within their jurisdiction. The Chairman of the People's Committee at the commune/ward level also has the authority to decide on land use right auctions, approve starting prices, and recognize winning bids for entities within their delegated authority.
In addition, the Decision also delegates to the Chairpersons of the People's Committees at the commune and ward levels the authority to perform tasks related to adjusting land use duration, extending land use, changing land use forms, recognizing land use rights, and approving various land use plans for agricultural land, rice cultivation land, and multi-purpose land.
According to the People's Committee of Can Tho City, this decentralization aims to ensure that land-related documents and procedures are processed quickly and in line with local realities, reducing pressure on the city level, while creating more favorable conditions for people and businesses when exercising their land-related rights.
The decision also clearly stipulates the responsibilities of the Chairpersons of the People's Committees at the commune and ward levels in organizing the implementation in accordance with the law, and being accountable to the City People's Committee and to the law for the delegated tasks. In particular, the heads of communes are not allowed to further delegate tasks that have already been assigned to them.
The Department of Agriculture and Environment of Can Tho City is tasked with monitoring and compiling any difficulties and obstacles arising during the implementation process in order to advise the City People's Committee on appropriate adjustments.
According to assessments by specialized agencies, decentralization in the land sector will contribute to improving the effectiveness and efficiency of state management, while simultaneously meeting the requirements of administrative reform and better serving the people in the new era.
