On May 18, 2023, the Investigation Police Agency of Bac Kan Provincial Police issued a decision to prosecute Nguyen Van Minh (born in 1954, residing in Group 8, Nguyen Thi Minh Khai Ward, Bac Kan City) for the crime of "Murder". The incident occurred at 20:50 on May 15, at Km159 on National Highway 3, through Nguyen Thi Minh Khai Ward, Bac Kan City.

Through alcohol testing, the Traffic Police Department of the Provincial Police determined that Nguyen Van Minh violated the level of 0.943 milligrams/liter of breath. When the team asked to check the vehicle documents, Minh asked to go home to get them. About 10 minutes later, Minh returned and suddenly used a knife to seriously injure Major Duong Xuan K. The wound tore his diaphragm and required the removal of his spleen. At the police station, the subject said that he was angry because the team stopped his car to check his alcohol concentration, so he went and bought two sharp knives and returned to take revenge.

Previously, in many localities across the country, there have been consecutive incidents involving drivers ramming into police officers when asked to stop for a violation inspection.

According to statistics from the Ministry of Public Security, in the first quarter of 2023, there were 28 cases of resisting law enforcement officers nationwide, injuring 10 traffic police officers. Compared to the same period in 2022, there were 20 more cases, 8 more traffic police officers injured, and 22 more arrests. Notably, the number of people using alcohol to resist traffic police increased to 17 cases, accounting for more than 50%.

The above incidents clearly demonstrate the recklessness, disregard for consequences, and disregard for the law of subjects when being inspected and handled by the traffic police for violations of road traffic safety and order.

According to the authorities, drivers who drink alcohol will not be able to control their mental and behavioral state; this is the reason why some violations include obstructing, resisting, and refusing to measure alcohol concentration when the traffic police request to check. The resistance and non-compliance with the orders and requests of traffic participants when requested by the authorities causes many difficulties for officers and soldiers in the performance of their duties.

According to statistics from the Traffic Police Department of Bac Kan Province, in the first 5 months of the year, the police units in the province arranged 3,570 patrol teams to control and handle violations of traffic safety with a total of 13,080 officers and soldiers participating. Through inspections, 4,294 violations were detected, fines were collected to the state budget of over 6.7 billion VND; driving licenses, certificates, and professional certificates were revoked in 1,184 cases; and 1,631 vehicles were temporarily detained. Of which, 1,161 cases were handled for alcohol concentration violations (accounting for 27% of the total number of violations), an increase of 955 cases compared to the same period last year.

Not directly opposing, some people have formed groups on social networks to inform each other of the locations of patrol and control teams to avoid the authorities. Notably, after the incident in which a traffic police officer was seriously injured, there were also some negative comments on social networks, distorting and blaming the authorities, encouraging acts of resistance.

For example, the Facebook account “Dong Hoang” commented with false content in the article “Bac Kan: Arrest of a subject resisting law enforcement officers” posted on the Fanpage of Bac Kan Provincial Police. The Department of Cyber Security and High-Tech Crime Prevention of the Provincial Police identified the user of the above Facebook account as HVĐ residing in Ba Be District and proceeded to work with this subject. During the working process, HVĐ was aware of the violation and voluntarily deleted the comment, pledging not to repeat the offense.

To ensure the strictness of the law and prevent acts of resisting law enforcement officers, it is necessary to have strict sanctions to deter and prevent in the community. In particular, each citizen needs to raise awareness of self-compliance with the law, not to be enticed or enticed into participating in acts that obstruct the activities of the authorities; boycott and condemn words and comments that distort and defame the authorities./.
