Proposal to add regulations on establishing sports clubs in residential areas to meet people's needs

VHO - The Ministry of Culture, Sports and Tourism is drafting a Circular amending and supplementing a number of articles of Circular No. 18/2011/TT-BVHTTDL dated December 2, 2011, regulating the model for organizing activities of grassroots sports clubs.

The establishment of sports clubs in residential areas will help perfect the legal system, creating favorable conditions for organizations and individuals in the process of establishing grassroots sports clubs in residential areas.

According to the Ministry of Culture, Sports and Tourism, Circular No. 18/2011/TT-BVHTTDL was developed in accordance with Decree No. 112/2007/ND-CP dated June 26, 2007 of the Government detailing and guiding the implementation of a number of articles of the Law on Physical Training and Sports , creating an important legal corridor for the organization, management and supervision of activities of grassroots physical training and sports clubs, promoting the development of physical training and sports clubs as well as expanding and improving the quality of physical training and sports activities at the grassroots level to date.

However, in the actual implementation process, there are still some shortcomings such as the process of establishing, recognizing and dissolving clubs is still complicated, cumbersome, time-consuming, causing difficulties for organizations, units, groups of people with the same interests who want to establish clubs... there needs to be adjustments and supplements to ensure compliance with the practical situation as well as the new policies and guidelines of the state on reducing administrative procedures, creating the most favorable conditions for people.

In addition, Circular No. 18/2011/TTBVHTTDL only mentions the establishment of sports clubs in agencies, organizations, armed forces units, schools, enterprises, production and business establishments, and does not mention the establishment of sports clubs in residential areas. Adding more locations for establishing sports clubs in residential areas will help complete the legal system, creating favorable conditions for organizations and individuals in the process of establishing grassroots sports clubs in residential areas.

In the context of promoting administrative reform, implementing the policy of streamlining the apparatus, merging a number of ministries, branches, provinces/cities, communes/wards, and abolishing the district level, the authority and names of a number of government levels and state management agencies in Circular No. 18/2011/TT-BVHTTDL have changed and are no longer suitable, and need to be revised and supplemented.

Therefore, it is necessary to develop a Circular amending and supplementing a number of articles of Circular No. 18/2011/TT-BVHTTDL to supplement and adjust the missing provisions in Circular No. 18/2011/TT-BVHTTDL, ensuring consistency and consistency with current laws; enhancing the effectiveness of professional management of grassroots sports activities; minimizing administrative procedures, creating favorable conditions for organizations and individuals to establish grassroots sports clubs; improving the quality and efficiency of grassroots sports clubs.

Draft amendments to points a and b, clause 1, Article 2 (Position of grassroots sports clubs):

Grassroots sports clubs are voluntary organizations established in communes, wards, special zones, villages, hamlets, residential groups (residential areas) and at agencies, organizations, unions, armed forces units, schools, enterprises, production, business and service establishments (agencies, units).

Grassroots sports clubs are under the management and professional guidance of the People's Committees of communes, wards, and special zones (commune level).

Thus, compared with Circular 18/2011/TT-BVHTTDL, the draft adds regulations on establishing sports clubs in residential areas to meet people's needs.

In addition, the draft abolishes Point c, Clause 1, Article 2: "Basic sports clubs are requested to make seals for transactions and open bank accounts according to the provisions of law" because it is inconsistent with current regulations. Only clubs established according to the provisions of Decree 126/2024/NDCP are allowed to make seals for transactions and open bank accounts according to the provisions of law.
