On the afternoon of October 28, at the 8th Session of the 15th National Assembly, authorized by the Prime Minister, Minister of National Defense Phan Van Giang presented a report on the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
The draft Law amends and supplements a number of contents including: Basic positions and equivalent positions and titles of officers; Maximum age limit for officers to serve in the army; highest military rank for positions and titles of officers.
In addition, it also stipulates a number of contents related to authority and more clearly defines a number of regimes and policies for officers, such as military rank promotion, early salary increase, social insurance regime, housing regime, land, health care, responsibilities of the Government , ministries, branches, localities, etc.

Proposal to raise retirement age of military officers
The Minister of National Defense said that the draft law amends and supplements regulations on the service age of active officers and reserve officers in Articles 13 and 38.
Specifically, for lieutenants, the maximum age limit for active officers (retirement age) increases from 46 to 50 years old. Majors from 48 to 52 years old. Lieutenant Colonels from 51 to 54 years old. Senior Colonels from 54 to 56 years old. Colonels from 57 years old (for men) and 55 years old (for women) to 58 years old (regardless of gender).
The age limit for generals remains 60 for men, and for women it increases from 55 to 60 years old.
The draft law also stipulates that when the military has a need, officers with sufficient political and moral qualities, good professional skills, good health and volunteering can have their service age extended for no more than 5 years.
Officers are professors, associate professors, doctors, specialist doctors 2, specialist pharmacists 2, chief engineers, leading scientists, officers with specialized or specific training or in special cases, the training period may be extended according to regulations of the Minister of National Defense.
The retirement age of reserve officers (including officers in the reserve force who are registered, managed, and trained to be ready to be mobilized into active service) is also proposed to be increased.
Specifically, the retirement age of reserve officer lieutenants will increase from 51 to 53 years old. Majors will increase from 53 to 55 years old. Lieutenant Colonels will increase from 56 to 57 years old. Colonels will increase from 57 to 59 years old. Colonels will increase from 60 to 61 years old. Generals will remain at 63 years old.
For the commander of the commune-level military command, the maximum age limit for service is implemented according to the provisions of the Labor Code.
Reviewing this content, Chairman of the National Defense and Security Committee Le Tan Toi said that the Committee basically agreed with the amendment in the direction of increasing the age limit for active service according to the highest military rank of officers of the Vietnam People's Army at different levels. The increase in retirement age is consistent with the Party's policy and consistent with the provisions of the 2019 Labor Code.
Chairman Le Tan Toi also said that there were opinions in the review agency suggesting that the drafting agency consider adjusting the retirement age of female officers with the rank of colonel to comply with the provisions of the Labor Code and the Law on Social Insurance, ensuring gender equality and taking advantage of qualified and experienced female human resources in the military.

Keep the maximum number of generals at 415 levels
With the highest rank for an officer position, the draft law proposes that the number of general ranks should not exceed 3, including the positions of Minister of National Defense, Chief of the General Staff, and Director of the General Political Department.
Senior Lieutenant General, Navy Admiral, the number is not more than 14, including: Deputy Minister of National Defense with the highest military rank of Senior Lieutenant General, Navy Admiral no more than 6; Deputy Chief of General Staff, Deputy Director of General Department of Politics, each position has the highest military rank of Senior Lieutenant General no more than 3. In addition, there are also Director, Political Commissar of National Defense Academy.
The positions and titles with the highest military ranks are Lieutenant General, Vice Admiral of the Navy, Major General, Rear Admiral of the Navy; the number does not exceed 398.
The total number of highest ranks, including generals, is 415, remaining the same as current law.
The positions and titles from Deputy Commander, Deputy Political Commissar of the Corps; Deputy Commander, Deputy Political Commissar of the Naval Region, to Platoon Leader (stipulated from point h to point r, article 11 of the law on officer positions), have the highest military rank of colonel and lieutenant.
The draft law also proposes that seconded military officers approved to hold the position of Standing Member of the National Assembly's National Defense and Security Committee or appointed to the position of General Director or equivalent have the highest military rank of Major General.
A seconded People's Army officer approved to hold the position of Deputy Chairman of the National Assembly's Committee on National Defense and Security or appointed to the position of Deputy Minister or equivalent has the highest military rank of Lieutenant General.
The People's Army officer seconded to hold the position of Chairman of the National Assembly's Defense and Security Committee has the highest military rank of Senior Lieutenant General.
The Minister of National Defense proposed that the National Assembly assign the Government to specify the position with the highest military rank of lieutenant general and major general, and the highest military rank for the position and title of an officer is the general rank of a newly established unit or a reorganized unit.
The reviewing agency, the National Assembly's Defense and Security Committee, basically agreed with the provision on the highest rank for officer positions in the draft law. This does not exceed the maximum number of general positions as decided by the competent authority. However, Chairman of the National Defense and Security Committee Le Tan Toi said that there were opinions in the reviewing agency suggesting that the drafting agency study and specify the number of lieutenant general and major general ranks as a basis for the Government to specify in detail.
There is also a proposal to review the position of seconded officers with a ceiling of general rank to comply with the regulation that the total number of general officers in service in the People's Army does not exceed 415./.
