The average living space in urban areas will reach 32 square meters per person by 2030.

On October 3rd, the Ministry of Construction held a conference to announce the urban and rural system planning for the period 2021-2030, with a vision to 2050. Prior to this, the plan had been approved by the Prime Minister at the end of August.

Presenting a summary of urban and rural planning, Dr. Pham Thi Nham, Deputy Director of the National Institute of Urban and Rural Planning, stated that to date, the country has formed two major urban regions: Hanoi and Ho Chi Minh City. The development orientation for the coming years will include four urban regions: Hanoi, Da Nang, Ho Chi Minh City, and Can Tho .

In the future, Vietnam's urban network will develop according to a model of urban regions and central cities at the national, regional, provincial, and district levels.

National-level central cities, including special cities and Type I cities, will play a dynamic role as driving urban centers, serving as the main growth poles in economic, social, and national security development, as well as in the restructuring of the regional economy and territory.

With the recently approved urban and rural planning, urban development in the coming years will be shaped into four urban zones.

Specifically, the Hanoi metropolitan area includes Hanoi, Hai Phong, Quang Ninh, Hung Yen, Hai Duong, Bac Ninh, Bac Giang, Vinh Phuc, Ha Nam, Thai Nguyen, Hoa Binh, and Phu Tho.

The Ho Chi Minh City metropolitan area includes Ho Chi Minh City, Binh Duong, Dong Nai, Ba Ria - Vung Tau, Tay Ninh, Binh Phuoc, Long An, and Tien Giang.

The Da Nang metropolitan area includes Da Nang City, Hue, and neighboring cities in the provinces of Quang Nam, Quang Ngai, and Binh Dinh.

The Can Tho metropolitan area includes Can Tho City and neighboring urban areas in the provinces of An Giang, Kien Giang, Vinh Long, and Dong Thap.

This plan also aims to develop Hanoi and Ho Chi Minh City into important growth hubs for the nation.

The approved plan sets targets for urbanization rates to reach over 50% by 2030 and 70% by 2050, with approximately 1,000 to 1,200 urban areas nationwide. This includes the formation of several national and regional urban centers with income levels equivalent to the average of cities in the top four ASEAN countries; and the urban economy contributing approximately 85% to the national GDP.

In addition, the goal is to build a network of national and regional smart city centers with international connectivity, and to have 3-5 cities with regionally and internationally recognized brands by 2030.

The ratio of transportation land to urban built-up land is approximately 16-26%, and the average housing area in urban areas is 32 m2/person.

Thanh Oai District, Hanoi, unexpectedly suspends land auctions.

The People's Committee of Thanh Oai district has just announced the suspension of auctions for 197 land plots in the Man Ca, Man Cong, Ma Man Trong areas, Van Quan village, Do Dong commune.

The reason is to ensure that the land use rights auction process in the district is conducted in accordance with the directives of the Hanoi City People's Committee.

The District People's Committee stated that, after checking and reviewing the documents and ensuring all legal conditions are met as directed by the City People's Committee, the district will continue to announce the auction of land use rights in accordance with regulations.

Shortly afterwards, the Vietnam Auction Partnership Company – the auction organizer – also announced the suspension of the auctions for 58 and 73 land plots in the Man Cá, Man Cổng, Mạ Man Trong areas, Văn Quán village, Đỗ Động commune.

According to this announcement, customers will be refunded the application fee and the deposit they paid.

Previously, the auction organizer announced the auction of the right to use 58 plots of land in the Man Cá, Man Cổng, and Mạ Man areas (belonging to the ONT-07 and ONT-08 series), scheduled to take place on the morning of October 5th.

The land plots range in size from over 76-189m2, with a starting price of 5.3 million VND/m2. Customers participating in the land auction must pay an upfront deposit of approximately 81-201 million VND.

For the other 73 plots of land in the same area, the starting price is also 5.3 million VND/m2. The area ranges from 87.5 to 161 m2, equivalent to 463 million to 926 million VND per plot. The deposit for each plot ranges from 93 to 185 million VND. This auction is scheduled to be held on October 19th.

This is not the first time Thanh Oai district has announced a temporary suspension of land auctions. Previously, on August 29th, the People's Committee of Thanh Oai district sent a document to the District Land Fund Development Center and the auction company regarding the temporary suspension of land use right auctions for 114 plots of land in the Dam area, Muc Xa hamlet, Cao Duong commune.

According to the plan, Thanh Oai district will auction these 114 plots of land in two sessions (57 plots in each session). Of these, 57 plots in the first phase will be auctioned on September 8th.

The District People's Committee stated that it will announce the rescheduling of the auction after reviewing the legal aspects and conditions to ensure compliance with the law.

Proposal to create a land price table for each individual plot of land.

According to Government Decree No. 71 issued in June regulating land prices, the Ministry of Natural Resources and Environment is responsible for specifying the details of the construction, adjustment, amendment, and supplementation of land price tables for each individual plot of land, based on value zones and standard plots.

While there are currently no specific regulations on establishing land price tables for each individual plot based on value zones and standard plots, the Ministry of Natural Resources and Environment believes that, in order to comply with the 2024 Land Law and other legal documents, as well as the practical requirements of land management in the current period, the development and issuance of a circular is essential.

To construct land price tables down to each individual plot based on value zones and standard plots, the draft regulations stipulate the collection of information and data to assess the conditions of the area for constructing land price tables down to each individual plot based on value zones and standard plots, including: digital cadastral maps; plot space and base land space in the land database; land use right registration information in the land database; data on land use planning and detailed construction planning approved by competent authorities…

The criterion for selecting a standard land plot is that the plot must have the highest frequency of occurrence of characteristics such as area, shape, and size within the value range.

Furthermore, the land plot has undergone minimal changes in location, purpose, shape, and planning. It has clearly defined boundaries, full legal documentation regarding land use rights and ownership of houses and assets attached to the land (if any), and is free from disputes over land use rights and ownership of houses and assets attached to the land (if any).

This draft Circular uses statistical analysis to determine how to adjust for each level of difference in each factor affecting land prices.

Simultaneously, the organization conducts land valuation surveys, gathers opinions from land users and experts on the suitability of valuation results for land parcels in each value zone compared to similar land parcels that have been transferred on the market or won through land use right auctions within the 24 months prior to the survey date…

Cases of revocation of land use right certificates issued under the Land Law of 2024

Clause 2, Article 152 of the amended Land Law of 2024, effective from August 2024, stipulates that the State shall revoke land use certificates issued in 6 cases.

Specifically:

a) The State shall reclaim the entire land area recorded in the issued Certificate of Land Use Rights, Certificate of Ownership of Housing and Land Use Rights, Certificate of Ownership of Housing, Certificate of Ownership of Construction Works, Certificate of Land Use Rights, Ownership of Housing and Other Assets Attached to Land, and Certificate of Land Use Rights and Ownership of Assets Attached to Land;

b) Reissuing/exchanging previously issued Certificates of Land Use Rights, Certificates of Ownership of Houses and Land Use Rights, Certificates of Ownership of Houses, Certificates of Ownership of Construction Works, Certificates of Land Use Rights, Ownership of Houses and Other Assets Attached to Land, and Certificates of Land Use Rights and Ownership of Assets Attached to Land;

c) Land users and owners of assets attached to the land who register changes in land and assets attached to the land that require the issuance of a new Certificate of Land Use Rights or Ownership of Assets Attached to the Land;

d) The certificate was issued without proper authority, to the wrong land user, for the wrong land area, without meeting the eligibility requirements, for the wrong land use purpose or duration, or for the wrong origin of land use as stipulated by land law at the time of issuance;

d) The issued certificate is declared invalid by a competent court;

e) In cases of auctioning or transferring land use rights and assets attached to the land at the request of the Court or enforcement agency, where the person obligated to comply with the judgment fails to submit the issued certificate.

Thus, the cases in which land use right certificates are revoked are stipulated as above.
