Draft Law on Teachers: Proposal not to stipulate the establishment of a separate salary scale for teachers

Continuing the 9th Session program, on the morning of May 6, the National Assembly discussed in the hall about the Law on Teachers.

Explaining, receiving and revising the draft Law, Chairman of the Committee for Culture and Society Nguyen Dac Vinh said: After receiving and revising, the draft Law consists of 9 chapters and 46 articles, 4 articles less than the draft submitted at the 8th Session .

Regarding the salary and allowance policy for teachers (Article 25), there are opinions suggesting considering the regulation that teachers' salaries are ranked highest in the administrative and career salary scale to be compatible with the possibility of changing salary policies in the future. There are opinions suggesting the development of a separate salary scale for teachers; regulating flexible salary scales according to the level of education and seniority of teachers.

Regarding this issue, the Standing Committee of the National Assembly believes that teachers in publiceducational institutions are civil servants; therefore, teachers' salaries are implemented according to the administrative salary scale applicable to civil servants. The policy on salaries and allowances of civil servants is currently stipulated in detailed regulations and implementation instructions; therefore, if the salary policy for civil servants changes, it will still be suitable for the teaching staff as civil servants.

The Chairman of the Committee on Culture and Society said: The Draft Law stipulates that teachers' salaries are ranked highest in the administrative career salary scale system (Point a, Clause 1, Article 25); in addition, teachers are entitled to preferential allowances for their jobs and other allowances depending on the nature of their work and the region as prescribed by law (Point b, Clause 1, Article 25). Therefore, it is proposed not to stipulate the establishment of a separate salary scale for teachers.

Regarding the regulation of flexible teacher salary scales according to educational levels, the National Assembly Standing Committee believes that it needs to be carefully studied in the process of developing salary policies according to job positions. Therefore, it is proposed that this content not be regulated in the draft Law.

Some opinions say that the draft Law should only stipulate principles and assign the Government to specify salary policies for teachers in accordance with job positions, in accordance with the policy and roadmap for salary policy innovation; propose to stipulate the retention of seniority allowances for teachers. Some opinions say that the draft Law does not have regulations on salary classification for those who are on probation, probation or guest lecturer; propose to review the regulations on allowances and special regimes for teachers in the draft Law to ensure that the regulations are consistent with the policy of salary policy innovation.

In response to the delegates' opinions, the National Assembly Standing Committee directed the revision of the draft Law in the direction of assigning the Government to specify in detail the salaries and allowances for teachers (Clause 4, Article 25). The salary arrangement for those who are on probation, on probation, and guest teachers will be specified in detail in the implementing guidance document.

In addition, there are suggestions that preschool teachers and primary school homeroom teachers should enjoy higher benefits than teachers at other levels. The National Assembly Standing Committee recognizes that the work of homeroom teachers at all levels of general education in general, and primary school homeroom teachers in particular, is considered part-time work and has been converted into teaching hours/periods. Therefore, this group is not eligible for higher benefits to ensure fairness and equality among teachers.

National Assembly delegates attending the session

Some National Assembly delegates expressed concerns and disagreement with the regulation on increasing the salary level of teachers recruited for the first time; requested a more thorough impact assessment and a more convincing explanation of the necessity of the policy, ensuring feasibility, consistency and equality with the team of cadres, civil servants and public employees in the political system.

In response to the opinions of National Assembly deputies, the draft Law was revised to remove the regulation on increasing starting salary by 1 level for teachers recruited for the first time to ensure the correlation with civil servants and workers in other sectors and fields.

There are suggestions to detail the mechanism for inspecting and supervising the implementation of salary policies for teachers at non-public educational institutions to protect teachers' rights in a reasonable and fair manner.

Mr. Nguyen Dac Vinh said that, according to current regulations, teachers in non-public educational institutions implement the labor contract regime according to the provisions of the law on labor. Employees in general and teachers in non-public educational institutions in particular implement the regulations on salary regime stipulated in the Labor Code (Chapter VI). The inspection and supervision of the implementation of salary policy is carried out according to the provisions of relevant laws; this content should not be stipulated in the draft Law.
