Vice Chairman of the Hanoi People's Committee Nguyen Trong Dong signed Decision No. 4979/QD-UBND dated September 24, 2024, assigning 5,436 m2 of land in Binh Xa village, Binh Phu commune, Thach That district to the Thach That District People's Committee (Thach That District Land Fund Development Center) to implement the investment project for the construction of technical infrastructure for auctioning land use rights in Binh Xa village, Binh Phu commune (Code BP01).
Accordingly, 5,426 m2 of land in Binh Phu commune, Thach That district (land clearance work has been completed as confirmed by the Thach That District People's Committee in Document No. 1613/UBND-TNMT dated August 15, 2024) is allocated to the Thach That District People's Committee (Thach That District Land Fund Development Center) to implement the investment project for the construction of technical infrastructure for the land use rights auction area, approved by the Thach That District People's Committee in Decisions: No. 5450/QD-UBND dated December 9, 2021, No. 1250/QD-UBND dated March 15, 2023, and No. 8577/QD-UBND dated December 15, 2023.
The location, boundaries, and area of the land plot are determined in the master plan drawing of the project for the construction of technical infrastructure for the land use rights auction area in Binh Xa village, Binh Phu commune, Thach That district, prepared by Vi Vuong Co., Ltd., and appraised by the Urban Management Department of Thach That district on November 12, 2021, and the attached diagram to the minutes of the meeting to check the boundary markers on the map and in the field on August 10, 2022, of the Department of Natural Resources and Environment.
Of the total land area of 5,426 m2, 2,411.1 m2 is residential land for auction. Land use form: State allocation of land without land use fees (Households and individuals winning the auction for residential land use rights will be allocated land by the State with land use fees collected. Land use term: Long-term); 3,014.9 m2 is land for technical infrastructure and green spaces. Land use form: State allocation of land without land use fees; Thach That District People's Committee (Thach That District Land Fund Development Center) will invest in the construction of technical infrastructure synchronous with the general infrastructure of the area according to the approved plan.
The People's Committee of Hanoi City assigns the People's Committee of Thach That District (Thach That District Land Development Center) to contact the Department of Natural Resources and Environment to receive the land handover on-site; to organize the construction of technical infrastructure according to the approved investment project, ensuring overall planning, synchronous connection of technical infrastructure and regional infrastructure; to be responsible for the preparation and approval of the overall site plan drawing, ensuring no interstitial land area is created, and that land is used economically and efficiently; to prepare a land use right auction plan for submission to the competent authority for approval and to organize the land use right auction in accordance with the procedures stipulated in the Land Law 2024, the Law on Auction of Assets 2016, the Decrees and Circulars guiding the implementation, and the current regulations of the City on land use right auctions for land allocation with land use fees or land lease in Hanoi City, ensuring compliance with legal regulations, transparency, and efficiency. Guide the winning bidder in fulfilling financial obligations, registering land use rights, preparing documents for applying for a construction permit and obtaining a certificate of land use rights, ownership of houses and other assets attached to the land in accordance with regulations. Use the land for the intended purpose, within the defined boundaries and area as stated above; implement the investment project in accordance with the law.
The Department of Natural Resources and Environment is responsible for determining the boundaries and handing over the land on the ground to the People's Committee of Thach That District (Thach That District Land Development Center).
The Hanoi Land Registration Office updates land use rights registration, processes land use change registrations, and adjusts land use changes in cadastral records according to regulations.
