Hanoi establishes a council to appraise valuable architectural works.

Vice Chairman of the Hanoi People's Committee, Duong Duc Tuan, has just signed Decision No. 3681 on the establishment of the Council for evaluating the list of valuable architectural works in Hanoi city.

Accordingly, the Council for evaluating the list of other valuable architectural works in Hanoi consists of 17 official members, chaired by Mr. Nguyen Trong Ky Anh - Director of the Department of Planning and Architecture.

If necessary, the City People's Committee and the Chairman of the Appraisal Council may consider inviting a number of experts to participate in the appraisal of issues requiring clarification for each group of project documents.

The Council is tasked with providing input and evaluating (creating new and adjusting) the list of valuable architectural works according to the assessment and classification criteria stipulated in Articles 3 and 4 of Government Decree No. 85.

The Department of Planning and Architecture (the permanent supporting agency of the Appraisal Council) is responsible for receiving, checking, preparing reports, and organizing the collection of appraisal opinions from the Appraisal Council at the request of the Chairman of the People's Committee of the City or at the suggestion of the Chairman of the Appraisal Council.

The unit in charge of organizing the proposal for content requiring feedback from the Appraisal Council is responsible for preparing the dossier and documents as requested by the Secretariat of the Appraisal Council.

The time limit for evaluating the list of architectural works is a maximum of 20 days from the date of receipt of a valid application.

The Hanoi People's Committee assigns the Hanoi Department of Planning and Architecture as the permanent agency of the Appraisal Council; to organize implementation according to the Regulations; and assigns the Department of Finance to research and guide the allocation of operating funds for the Appraisal Council in accordance with regulations.

Previously, the Ministry of Construction sent document 1943 to the Hanoi People's Committee regarding the organization of the establishment of regulations on architectural management in Hanoi.

Accordingly, the organization of drafting, appraisal, approval, and promulgation of the Regulations on Architectural Management in Hanoi City shall be carried out in accordance with the authority, responsibility, procedures, and regulations of the 2019 Architecture Law, Government Decree No. 85 detailing some provisions of the Architecture Law, detailed regulations and guidelines for implementation, and the Plan for the Implementation of the Architecture Law issued by the Prime Minister in Decision No. 1037.

Regarding this matter, the Ministry of Construction has issued documents No. 78 and No. 2696 to the Hanoi Department of Planning and Architecture, providing guidance on the preparation of regulations on architectural management and a list of architectural works of value under the Law on Architecture in Hanoi.

According to Clause 4, Article 14 of the 2019 Architecture Law, the Provincial People's Committee shall develop architectural management regulations and submit them to the Provincial People's Council for approval before promulgation. The responsibility for submitting the regulations to the Provincial People's Council for approval before promulgation rests with the Provincial People's Committee.

According to Clause 2, Article 9 of Government Decree No. 85 detailing some provisions of the Law on Architecture, the specialized architectural agency under the Provincial People's Committee is responsible for organizing the appraisal of architectural management regulations .
