The City People's Council agreed that clearly defining the authority and responsibility of each level of local government is necessary and important for the effectiveness of state management and socio-economic development, contributing to increasing initiative in deciding and implementing assigned tasks; increasing publicity and transparency in government activities; promoting administrative reform and better serving people and businesses.
In particular, in the context of transition to a two-level local government model, clearly defining the authority and responsibility of each local government entity ensures the smooth and effective operation of the new administrative apparatus.
However, according to Clause 1, Article 13 of the Law on Organization of Local Government: “The People's Council at the provincial level decentralizes to the People's Committee at the same level or the People's Council at the commune level; the People's Committee at the provincial level, the Chairman of the People's Committee at the provincial level decentralizes to specialized agencies, other administrative organizations under the People's Committee at its level, the People's Committee, the Chairman of the People's Committee at the commune level continuously and regularly perform one or several tasks and powers assigned to them according to the provisions of law, except in cases where the law stipulates that decentralization is not allowed”.
Thus, according to the above regulations, the City People's Council only delegates to the City People's Committee or the Commune People's Council one or several tasks and powers assigned according to regulations.
After consideration and discussion, the City People's Council agreed with the inspection report of the Economic - Budget Committee of the City People's Council and the supplementary report of the City People's Committee and resolved: Abolish Resolution No. 21/2022/NQ-HDND dated September 12, 2022 of the City People's Council on decentralization of state management of a number of socio-economic fields in Hanoi .
The City People's Council assigns the City People's Committee to organize the implementation of the division of authority and assignment of management tasks in the area in accordance with the provisions of specialized laws and instructions of central ministries and branches; and to issue detailed instructions to ensure that the management of socio-economic fields is implemented synchronously, transparently and effectively in practice.
During the implementation process, for any issues related to the authority of the City People's Council, the City People's Committee is requested to report to the competent authority to submit to the City People's Council for consideration according to the prescribed authority. At the same time, strengthen leadership, direction, decentralization, delegation of authority, individualization of responsibilities, increase flexibility and initiative in management, link direction with inspection, supervision, promptly resolve difficulties, obstacles, and bottlenecks in the spirit of 6 clear: Clear people, clear work, clear responsibility, clear authority, clear time and clear results.
