Papers and documents proving legal residence for permanent and temporary residence registration; Records and procedures for canceling permanent and temporary residence registration are prescribed in Decree 154/2024/ND-CP effective from January 10, 2025.
The Government has issued Decree No. 154/2024/ND-CP (referred to as Decree 154) detailing a number of articles and measures to implement the Law on Residence.
The information in the article provides you with 3 important contents stipulated in Decree 154 detailing a number of articles and measures to implement the Law on Residence, including: Papers and documents proving legal residence for permanent and temporary residence registration; Records and procedures for deleting permanent and temporary residence registration; and 15 information fields of the Residence Database.
I. Documents and papers proving legal residence for permanent and temporary residence registration from January 10, 2025
Papers, documents, information proving legal residence (as prescribed in Article 5)
1. Citizens shall provide information proving legal residence to the residence registration authority when submitting residence registration application; In case the information proving legal residence cannot be exploited in the database, information system or national identification application, the residence registration authority shall be responsible for checking and verifying to resolve residence procedures;
Citizens are responsible for providing a copy, photocopied copy, or electronic copy of one of the documents or papers proving legal residence when requested by the residence registration authority.
2. Documents proving legal residence for permanent residence registration are one of the following documents:
a) Papers and documents certifying land use rights and ownership of assets attached to land;
b) Housing construction permit or housing construction permit;
c) Documents on the purchase and sale of state-owned houses or documents on the valuation and liquidation of houses attached to state-owned land according to the provisions of law;
d) Contract for sale of housing or documents proving the handover or receipt of housing from the real estate business enterprise investing in construction for sale;
d) Documents on purchase, hire-purchase, donation, inheritance, capital contribution, and exchange of housing in accordance with the provisions of law on land and housing;
e) Documents on donating gratitude houses, charity houses, solidarity houses, granting housing and land to individuals and households;
g) Documents of the Court or competent state agency resolving the ownership of the house that have come into legal effect;
h) Documents and papers proving the mortgage or pledge of legal ownership of accommodation;
i) Confirmation from the People's Committee at the commune level that the house and land are in stable use, have no disputes and are not located in a location where new permanent residence registration is not allowed according to Form No. 02 issued with this Decree;
k) Documents and papers proving the registration and inspection of vehicles owned, confirmation of registration of regular parking places of the vehicle, except for cases where registration of regular parking places is not required as prescribed in Clause 2, Article 3 of this Decree;
l) Contracts and documents on leasing, lending, or accommodation must be notarized or certified in accordance with the provisions of law;
m) One of the other types of papers and documents to consider granting a certificate of land use rights and ownership of other assets attached to land according to the provisions of the law on land and housing over the periods.
3. Documents proving legal residence for temporary residence registration are one of the following documents:
a) One of the papers and documents specified in Clause 2 of this Article, except for the case where the papers and documents proving legal accommodation are documents on leasing, lending, or allowing legal accommodation by an agency, organization, or individual, such document does not need to be notarized or certified;
b) A citizen's written commitment that he/she has a place of residence under his/her own use, has no dispute over the right to use, and is living stably and permanently at that place of residence if he/she does not have one of the papers and documents specified in Point a of this Clause.
c) Documents and papers of the owner of the tourist accommodation establishment or other accommodation establishment allowing the individual to register for temporary residence at that establishment;
d) Documents from the agency or organization managing the industrial park, export processing zone, or economic zone allowing the employee to register for temporary residence at the accommodation owned or managed by the agency or organization according to the provisions of law;
d) Documents from the agency or organization managing the construction site, dormitory, craft village, production and business establishment or organization allowing the employee to register temporary residence at the accommodation under their ownership or management in accordance with the provisions of law.
4. Documents and papers proving the minimum housing area required for permanent residence registration at a legal place of residence rented, borrowed, or rented as prescribed in Clause 3, Article 20 of the Law on Residence.
II. Procedures for deleting permanent and temporary residence registration
According to regulations, within 7 days from the date a household has a person whose permanent or temporary residence registration is cancelled, the person whose permanent or temporary residence registration is cancelled or the household representative is responsible for carrying out the procedure for cancelling the permanent or temporary residence registration.
The file to cancel permanent or temporary residence registration includes: Application form for change of residence information and documents proving one of the cases of cancellation of permanent or temporary residence registration.
The person carrying out the procedure submits 1 application online, directly or via public postal service to the residence registration agency.
In case the person proposed to have his/her permanent or temporary residence registration deleted does not have information in the National Population Database or the information about that person in the National Population Database is incomplete or inaccurate, the residence registration agency is responsible for collecting and updating the National Population Database.
Upon receiving valid documents, the residence registration agency shall delete the permanent or temporary residence registration for citizens and update the deletion of permanent or temporary residence registration in the Residence Database and the National Population Database.
In case a person subject to permanent or temporary residence registration cancellation or a household representative fails to carry out the procedures for permanent or temporary residence registration cancellation, the residence registration authority shall be responsible for checking, verifying, and making a record of the citizen or household representative's failure to carry out the procedures for permanent or temporary residence registration cancellation and performing the permanent or temporary residence registration cancellation for the citizen.
Agencies and units managing people studying, working and working in the people's armed forces shall have a written request for the residence registration agency in the stationed area to cancel the permanent or temporary residence registration of people under their management.
The request must clearly state the last name, middle name and given name; date of birth; personal identification number or 9-digit identity card number of the person whose permanent or temporary residence registration is to be deleted; and the reason for requesting deletion of permanent or temporary residence registration.
Within 1 working day from the date the National Population Database receives the information reflecting the provisions in Clause 1 of Article 24 and Article 29 of the Law on Residence, the residence registration agency shall be responsible for checking, verifying, and deleting the permanent and temporary residence registration of citizens and updating the deletion of permanent and temporary residence registration in the Residence Database and the National Population Database.
3. The residency database will include 15 information fields:
1. Residence record number.
2. Information specified in Clauses 1 to 15, Clauses 21 to 25, Article 9 and Clause 4, Article 15 of the Law on Identification includes: Surname, middle name and birth name; other names; personal identification number...
3. Other names.
4. Place of permanent residence, time of starting permanent residence; reason and time of cancellation of permanent residence registration.
5. Place of temporary residence, time of starting temporary residence, duration of temporary residence; reason and time of temporary residence cancellation.
6. Status of temporary absence declaration, subject of temporary absence declaration, duration of temporary absence, destination during temporary absence, time of ending temporary absence.
7. Current location, start time to current location.
8. Place of stay, length of stay.
9. Criminal record.
10. Criminal record.
11. Preventive measures are applied.
12. Clear criminal record.
13. Number, name of the agency, competent person issuing, date, month, year of issuance of the document granting Vietnamese nationality, renunciation of Vietnamese nationality, deprivation of Vietnamese nationality, and cancellation of the decision to grant Vietnamese nationality.
14. Number, date, month, year, agency issuing the decision to search, search, or suspend wanted.
15. Other citizen information is integrated and shared from other databases.
The database on residence is built and managed centrally and uniformly at the identity management agency of the Ministry of Public Security.
The Decree takes effect from January 10, 2025.
