How to understand no stopping and parking signs to avoid fines?

Many drivers have been fined for stopping or parking in the wrong place. The reason is sometimes not because of intentional violations but because of not understanding the meaning of the prohibition signs.

In fact, many new drivers or those who have not yet driven a car do not clearly distinguish between the two types of signs "No Parking" and "No Stopping, Parking". Therefore, there are still some who mistakenly believe that if you only stop for a few minutes, turn on the hazard lights and do not leave the driver's seat, you can stop anywhere. This causes many people to receive a ticket but still feel confused.

Talking to Thanh Nien reporter, Mr. D.MH, a resident of Go Vap district, Ho Chi Minh City, said that he had just paid a parking fine in a place with a "No parking" sign on Nguyen Van Troi street, Phu Nhuan district, Ho Chi Minh City. Mr. H. shared: "At that time, I only stopped for about 4-5 minutes to wait for a friend, the car was still running and I was still sitting inside the car." However, the authorities also explained that Mr. H.'s behavior violated the regulations on the place where the sign prohibiting stopping and parking, even for a short time.

The Law on Road Traffic Order and Safety 2024 clearly explains the two states of stopping and parking.

Pursuant to Clause 1, Article 18 of this Code, a stopped vehicle is a vehicle that is temporarily stationary for a short period of time, sufficient for people to get on or off the vehicle, load or unload goods, perform technical inspections, and perform other actions. During the stop, the driver must not turn off the engine or leave the driver's seat except in necessary cases such as opening the vehicle door, loading or unloading goods, but must still ensure safety measures such as applying the brakes.

Meanwhile, Clause 2, Article 18 of the Law on Road Traffic Order and Safety also clearly explains that parking is defined as a state of standing still for an unlimited period of time. The driver can turn off the engine and leave the vehicle, but must first apply the handbrake or take other safety measures. In addition, when parking on a slope, the driver must steer toward the curb or block the wheels to prevent the vehicle from rolling.

Corresponding to these two concepts are two types of traffic signs that are clear but many drivers pay little attention to and often confuse them: "No stopping and parking" (P.130) and "No parking" (P.131).

Pursuant to Circular 51/2024/TT-BGTVT and QCVN 41:2024/BGTVT, sign P.130 prohibits all stopping and parking in the area where the sign is placed, except for priority vehicles. The sign is effective from the location of the sign to the intersection or until the sign "End of all prohibitions" is displayed...

Meanwhile, sign P.131 only prohibits parking, but still allows temporary stopping, as long as the driver does not leave the vehicle and must comply with safety conditions according to the law.

What is the penalty for stopping and parking in violation of regulations?

The penalty for violating the no-stopping and parking signs is also clearly stated in Point e, Clause 3, Article 6 of Decree 168/2024/ND-CP (Decree 168).

Specifically, drivers who park in areas with "No parking" or "No stopping and parking" signs will be fined from 800,000 to 1 million VND.

Meanwhile, the act of stopping or parking in violation of regulations, causing traffic congestion, the fine will increase from 4 to 6 million VND and the driver will have 2 points deducted from the driver's license. The penalty level is clearly stated in Point k, Clause 5, Article 6 of Decree 168.

In fact, many people subjectively think that just "parking for a bit and then going" or "sitting in the car is fine"... but current regulations are not based on emotions. Understanding the difference between "stopping" and "parking", along with observing the correct signs in the parking area will help drivers avoid being fined.
