Hoa Binh province lists numerous projects involved in land and construction violations.

Recently, the Inspectorate of Hoa Binh province issued Inspection Conclusion No. 27/KL-TTr concluding on the compliance with legal regulations on land, finance, and construction for the implementation of projects where the state allocated land, leased land, or recognized land use rights for organizations and enterprises in Mai Chau district during the period 2011-2021.

During the inspection process, the Hoa Binh Provincial Inspectorate discovered many businesses with violations in the fields of land and construction, specifically:

The Mai Chau Ecologdge eco -tourism and resort project (invested by Mai Chau Eco-tourism and Resort Co., Ltd.) was granted permission by the Hoa Binh Provincial People's Committee to convert 17,395.5 ^m² of production forest land to non- agricultural production and business land. However, the investor failed to provide documents related to determining the forest area on the production forest land and documents for reforestation.

Furthermore, this unit failed to provide planning documents and construction permits, while in reality it had already constructed: 19 guesthouses with a total construction area of 2940 ^m² ; a reception building and restaurant with an area of 225 ^m² ; a conference hall and staff housing with an area of 93.1 ^m² ; a tour guide's house with an area of 100 ^m² ; a swimming pool with an area of 249.9 ^m² ; and internal courtyards and gardens.

The investor of the Bamboo Panel Manufacturing Plant Project, BWG Mai Chau Joint Stock Company, failed to provide the design appraisal documents or construction permits for the structures built on the project land.

The Hop Thuy commercial and service complex project (invested by Hop Thuy Commercial Services Co., Ltd.) has completed construction and is operational, but the investor has built the structure in violation of the approved construction permit and master plan. Specifically, the permitted area for the garden and parking lot is 624 ^m² , but the actual construction area is only 444.61 ^m² . Therefore, the project violates regulations regarding the parking lot area and building density.

The aforementioned violation resulted in a Decision No. 90/QD-XPHC dated July 1, 2020, issued by the Inspectorate of the Department of Construction of Hoa Binh province, imposing a fine of 40 million VND on Hop Thuy Trading and Service Co., Ltd. The company has paid the fine into the account of the Department of Construction of Hoa Binh province but has not yet complied with Point c, Clause 6, Article 1 of Decision No. 90/QD-XPHC, which stipulates that within 60 days, the company must submit an application to the competent authority for an amended construction permit for the project.

The constructions belonging to Phase 1 of the AVANA Mai Chau Resort Project (invested by AVANA Mai Chau Co., Ltd.) have been completed and are in operation. However, during an inspection, the Hoa Binh Provincial Inspectorate discovered that the construction did not comply with the building permit issued by the Hoa Binh Provincial Department of Construction, specifically: a two-story administrative building; a bar and swimming pool; a one-story restaurant; a one-story villa with a swimming pool; a one-story luxury guesthouse; a one-story guesthouse; a courtyard house in the spa area; spa pavilions No. 1 and 2; a health consultation room and a one-story building; and the absence of one wastewater treatment plant…

AVANA Mai Chau Company explained to the authorities that, during the construction of the project, due to the complex terrain, the company adjusted some items to suit the function and needs of customers in order to ensure the business operates efficiently and fulfills its financial obligations to the state.

Regarding the Mai Chau Commercial and Service Complex Project (Sub-area 2, Mai Chau town, Mai Chau district), the investor, Mai Chau Trading Co., Ltd., is currently leveling the project land and has poured concrete slabs on the surface of Van Stream without a construction permit. On March 15, 2022, the investor was fined 4 million VND by the Road Management Department 1 for administrative violations in the field of road traffic. The reason for the fine was the failure to restore the original condition caused by the administrative violation. The company has paid the fine but has not yet implemented remedial measures to restore the original condition.

The People's Committee of Mai Chau district also granted construction permits outside its authority as stipulated in Article 8 of Decision No. 20/2020/QD-UBND dated November 13, 2020, on the promulgation of regulations on the management of construction permits in Hoa Binh province, for the Ngoc Bach Conference Center Project (invested by Ngoc Bach One-Member Limited Liability Company).

At the Clean Medicinal Herb Cultivation and Processing Project (Thung Khe commune, Mai Chau district), the investor, Thung Khe Agricultural Tourism Joint Stock Company, is using a level 4 worker's house, approximately 30 ^m² in area, with brick walls, marble floor, and corrugated iron roof (acquired from the transfer of land assets from Lan Tran Environmental Technology Investment and Application Company Limited, now Mai Chau Construction Joint Stock Company), but has not obtained a construction permit from the competent authority.

The Inspectorate of Hoa Binh province has requested relevant agencies such as the Department of Natural Resources and Environment, the Department of Construction, the Department of Agriculture and Rural Development, etc., to coordinate, inspect, review, and definitively handle the aforementioned violations.
