Accordingly, the administrative review of anti-dumping tax on Vietnamese honey is based on the review request of the plaintiff, US importers and Vietnamese honey exporting enterprises.
The Trade Remedies Authority of the Ministry of Industry and Trade said that the review period is from August 25, 2021 to May 31, 2023. The review list is expected to include enterprises exporting honey to the United States. Any enterprise on this list that does not export honey to the United States during the review period must notify the US Department of Commerce (DOC) within 30 days from the date of notification of the initiation of the review (expected to be until September 2, 2023).
According to the regulations, within 35 days from the date of announcement of the initiation of the review (expected September 7, 2023), the US Department of Commerce (DOC) will select enterprises as mandatory respondents in the case based on the export volume of the enterprises from high to low according to CBP data. In addition, within 90 days from the date of announcement of the initiation of the review, the parties can withdraw their request for review (expected November 1, 2023).
According to the Trade Remedies Authority, for some countries that the United States considers to be non-market economies such as Vietnam, in order to enjoy separate tax rates, enterprises must apply for separate tax rates within 30 days from the date of initiation of the review (expected to be September 2, 2023). In case enterprises do not apply for separate tax rates and are not selected as mandatory respondents, enterprises may be subject to a nationwide tax rate.
The US Department of Commerce (DOC) is expected to issue its review results no later than June 30, 2024. In the coming period, the US Department of Commerce will request information from the parties to select a surrogate country for Vietnam, a Quantity and Value questionnaire, and a mandatory respondent questionnaire.
Previously, on May 14, 2022, the US Department of Commerce initiated an anti-dumping investigation into Vietnamese honey. On November 17, 2021, DOC issued a preliminary conclusion and imposed a tax of 410.93% to 413.99% on Vietnamese honey.
On April 8, 2022, the US Department of Commerce issued a final conclusion, according to which Vietnam's dumping margin was significantly reduced, about 7 times compared to the preliminary conclusion, to 58.74% - 61.27% thanks to a partial adjustment of the calculation method as requested by Vietnam.
In June 2022, the US Department of Commerce issued an official anti-dumping duty order of 58.74% to 61.27% on Vietnamese honey products imported into the US for 05 years from June 3, 2022 and will conduct annual administrative reviews of anti-dumping duties.
