Strengthening the management of food production and trading enterprises, improving the effectiveness of ensuring the safety and quality of food products.
According to the Ministry of Health , the 2010 Food Safety Law and Decree No. 15/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of a number of articles of the Food Safety Law have established a legal mechanism in food management. However, in the process of implementing the Food Safety Law, due to many difficulties and problems from practice, Decree No. 15/2018/ND-CP has established a more flexible legal mechanism in food management based on practical situations, especially the post-inspection mechanism, risk management, simplification and reduction of a series of administrative procedures.
Decree 15/2018/ND-CP is assessed by the business community and associations as an achievement in reforming and improving the business environment with high efficiency, "reducing over 90% of administrative costs, saving 10 million working days and 3,700 billion VND" and is assessed by the Government as effective in terms of state management methods.
However, in recent times, there have been continuous incidents of fake food supplements, fake milk powder, and fake health protection foods on a large scale, causing public outrage. The Prime Minister has issued the following Official Dispatches: Official Dispatch No. 40/CD-TTg dated April 17, 2015, 41/CD-TTg dated April 17, 2025, 55/CD-TTg dated May 2, 2025, 65/CDTTg dated May 15, 2025, 72/CD-TTg dated May 24, 2025 and Directive No. 13/CT-TTg dated May 17, 2025 directing the Ministry of Health to closely coordinate with ministries, branches and localities to urgently review problems and inadequacies in legal regulations to promptly amend and supplement according to their authority or propose and recommend competent authorities to amend and supplement issues beyond their authority.
Recent incidents show that both the Law and Decree No. 15/2018/ND-CP have revealed many limitations and inadequacies, especially the regulations related to self-declaration, registration of declarations and food advertising. These are hot issues, of public concern and need to be amended and supplemented immediately to suit the reality and management requirements in the new situation.
Therefore, in order to promptly overcome and remove difficulties and obstacles caused by the above-mentioned provisions of the law on food safety, it is necessary to issue a Government Resolution on the mechanism for handling some difficulties and obstacles of the law on food safety.
The purpose of developing the Resolution on the declaration and registration of food products is to promptly resolve limitations, difficulties and inadequacies in current regulations of the Food Safety Law and Decree 15/2018/ND-CP; strengthen the management of food production and trading enterprises, improve the effectiveness of ensuring the safety and quality of food products; strengthen post-inspection work to improve the effectiveness and efficiency of the implementation of legal regulations on food safety and improve product quality.
Health protection foods must register food product declaration.
The draft Resolution proposes to regulate two food management mechanisms: declaring applicable standards (self-declaration) and registering food product declarations.
The Draft Resolution clearly stipulates in which cases the declaration of applicable standards is applied , and in which cases the registration of food product declaration is applied , to avoid cases where enterprises self-determine, classify products and apply declaration procedures that are not in accordance with the criteria and properties of the product, specifically:
1- For pre-packaged processed foods, food additives and food processing aids and utensils and packaging materials containing foods that do not have national technical regulations or have national regulations but do not have quality and micronutrient indicators, the applicable standards must be declared .
2- For health protection foods, medical nutritional foods, foods for special diets, food supplements; nutritional products for children up to 36 months old, the procedure for registering the food product declaration must be carried out.
For domestically produced or imported products and raw materials used only for the production and processing of export goods or for internal production of organizations and individuals that are not consumed in the domestic market, imported products for aid purposes are exempted from the procedure of declaring applicable standards.
For health protection food products, medical nutritional food, food for special diets, supplementary food; nutritional products for children up to 36 months old imported for aid purposes are exempted from self-declaration of quality and registration of food product declaration.
