Recently, Deputy Minister of Justice Nguyen Thanh Tu chaired a meeting of the Council for Appraisal of the High Technology Law (amended) project. The report at the meeting said that the High Technology Law was passed by the National Assembly in 2008 - the first and only law regulating the high technology sector in Vietnam. After more than 15 years of implementation, many regulations are no longer suitable to the development reality, need to be updated to meet the new requirements of the economy and the strong development of science and technology in the country as well as the world.
Overview of the meeting.
This draft Law consists of 06 chapters and 29 articles, restructured in a concise and clear direction, to ensure feasibility and consistency with the current legal system. The amendment aims to institutionalize the spirit of Resolution No. 57-NQ/TW dated August 10, 2023 of the Politburo on science, technology and innovation development to 2030, with a vision to 2045, thereby building a transparent and stable legal environment, facilitating investment and business activities in the high-tech sector.
At the meeting, many comments assessed that the draft had covered the key contents, and proposed to clarify some regulations related to incentive mechanisms and criteria for establishing high-tech agricultural zones, urban areas and regions. Quantifying specific regulations is considered necessary to increase transparency and ensure effective implementation of policies.
Delegates also emphasized the importance of ensuring security and safety in investment and technology development activities, especially for projects with foreign elements; at the same time, encouraging domestic enterprises to develop the capacity to master, transfer and commercialize strategic technologies.
In addition, many proposals aim to develop high-tech and supporting industries, creating conditions for businesses to participate more deeply in the global value chain, develop the production of components and core materials. Incentive mechanisms are recommended to be built in a clear direction, consistent with relevant laws, making it easy for businesses to access and apply.
In his concluding remarks, Deputy Minister Nguyen Thanh Tu emphasized that the amendment of the Law needs to ensure focus and strategic orientation, giving priority to areas with the potential to create breakthroughs. The Deputy Minister requested the drafting agency to continue to perfect the content, develop key programs on research, testing and technology transfer, and clearly define the functions of high-tech agricultural zones and regions.
According to the submission, the draft Law on High Technology (amended) adds many new contents such as: Supporting enterprises in manufacturing strategic technology products; promoting research and development (R&D); applying the super tax deduction mechanism for research activities; supporting the establishment of key laboratories, commercialization of inventions, product design, and development of domestic supply chains, contributing to promoting national innovation capacity.
