Regarding the case of 6 war veterans in Dak Nong being prosecuted for destroying production forests ( Thanh Nien reported), Senior Lieutenant General Be Xuan Truong, Chairman of the Vietnam War Veterans Association, has just signed a document requesting that the Permanent Deputy Chief Justice of the Supreme People's Court Nguyen Tri Tue pay attention to the settlement of the case, promptly provide guidance to ensure that the trial is truly objective, fair, and in accordance with the law, without injustice, contributing to protecting the rights and legitimate interests of war veterans and their families.
In the 6-page petition, Senior Lieutenant General Be Xuan Truong raised many issues of the case that have not been clarified by the investigation agency. The document stated: "The investigation conclusion of the Gia Nghia City Police Department's Investigation Police Agency is not objective and comprehensive. Not only does it not meet the requirements of the Supreme People's Court in Ho Chi Minh City, it still uses previous investigation documents that violate the law to propose prosecution of the defendants."
Previously, in both first-instance trials, the Gia Nghia City People's Court (Dak Nong) sentenced the 6 defendants, who were war veterans, to 6-7 months in prison. The defendants appealed, claiming that in fact, before clearing the forest land in sub-area 1710 (Gia Nghia City), there was no forest left. In the first appeal trial, the Dak Nong Provincial People's Court overturned the first-instance judgment. At the end of 2017, the Dak Nong Provincial People's Court held the second appeal trial, rejected the appeal, and upheld the first-instance judgment.
After serving their sentences and being released from prison, the six war veterans continued to send petitions for redress everywhere. In 2020, the verdict of the Dak Nong Provincial People's Court was appealed by the Chief Justice of the High People's Court in Ho Chi Minh City for a final review. Immediately afterwards, the Judicial Committee of the High People's Court in Ho Chi Minh City raised 9 issues showing that there was insufficient evidence to convict the defendants, accepted the appeal, and annulled both verdicts convicting the defendants for reinvestigation.
At the end of April 2023, during the third first-instance trial, Gia Nghia City People's Court returned the case file to Gia Nghia City People's Procuracy to reinvestigate 4 issues, due to lack of evidence to prove 6 war veterans for the crime of forest destruction.
