The draft Decree replacing Decree No. 114 consists of four chapters, 35 articles and attached appendices. The drafting agency is the Ministry of Agriculture and Environment . Up to now, the draft has basically been completed and the Government members have been consulted.
The Draft Decree replaces Decree No. 114 regulating the safety management of dams and reservoirs for dams with a height of 5m or more or reservoirs with a total capacity of 50,000 m³ or more and ensuring safety for downstream areas of the dam. The Draft Decree supplements a number of regulations on the safety management of dams and hydroelectric reservoirs that have been stipulated in Decree No. 62/2025/ND-CP.
Including specific classification of dams and hydroelectric reservoirs, declaration and registration of dam and reservoir safety, reservoir operation procedures, record keeping, monitoring of dam and reservoir works, and specialized hydrometeorological monitoring.
In addition, the draft Decree clearly stipulates a number of main contents such as: Amending regulations on safety of dams and hydroelectric reservoirs; classification of dams and hydroelectric reservoirs; declaration and registration of dam and reservoir safety; reservoir operation procedures, record keeping, monitoring of dam and reservoir works; specialized hydrometeorological monitoring; dam and reservoir safety inspection; maintenance, repair, upgrading, modernization of works and equipment, installation of operational monitoring systems; emergency response plans; database system on works operation; scope of works protection....
At the conference, delegates basically agreed with the draft Decree, and proposed to adjust and supplement the regulations on dams and hydroelectric reservoirs as stipulated in Decree No. 62/2025/ND-CP.
Concluding the conference, Deputy Prime Minister Tran Hong Ha basically agreed with the draft Decree replacing Decree No. 114. However, the Decree needs to have specific regulations, ensure transparency, clarity, consistent management, have regulations on decentralization and delegation of power to localities, and promote state management in the field of irrigation.
The draft Decree has been sent to ministries, branches, localities, scientists and experts for comments. Deputy Prime Minister Tran Hong Ha assigned the Ministry of Agriculture and Environment and the Government Office to absorb and edit the inconsistent contents and different opinions of the draft Decree. At the same time, fully synthesize the opinions of the delegates, develop the Decree in line with the provisions of the law, submit it to the Prime Minister for promulgation, and soon put the Decree into implementation in practice, contributing to ensuring the safety of reservoirs and dams.
