Traffic congestion is on the rise
The Ministry of Transport said that recently, the Government, the Ministry of Public Security , the Ministry of National Defense and the People's Committees of localities have paid great attention, created favorable conditions and a series of urgent and fundamental solutions to remove difficulties and obstacles in vehicle registration, especially in the field of road motor vehicles.
According to the Ministry of Transport , it is predicted that at least 36 localities are at risk of vehicle inspection congestion in the coming time.
Therefore, the traffic congestion at vehicle inspection centers has been basically resolved since the end of June 2023.
However, according to actual statistics and forecasts of the Vietnam Register, from the third and fourth quarters of 2024, some localities such as Binh Thuan , Dong Nai, Dong Thap, Ha Giang, Hanoi, Kon Tum, Lam Dong, Thai Binh, Thua Thien Hue, Ho Chi Minh City and Tra Vinh will be at risk of traffic congestion at the registration centers.
In particular, in Hanoi and Ho Chi Minh City, there have been local traffic jams at certain times as reported by the press recently.
According to statistics from the Vietnam Register, the whole country has 274/294 inspection centers with 446/546 inspection lines in operation with a minimum inspection capacity of 642,240 vehicles per month. With the number of inspection units and inspection lines mentioned above operating and operating normally, it is completely possible to meet the inspection needs of people and businesses nationwide in 2024 (the highest monthly inspection demand nationwide is only over 500,000 vehicles).
However, the uneven distribution of inspection density, with some places lacking and others having excess, leads to the risk of congestion of inspection vehicles recurring.
This situation is likely to increase in the coming months, when cases related to the field of vehicle inspection in localities are brought to trial, which will greatly impact inspection activities in many localities because a series of vehicle inspectors will be at risk of being convicted by a verdict (according to statistics, there are 42 localities with 112 vehicle inspection centers with vehicle inspectors being prosecuted).
According to the provisions of Point b, Clause 2, Article 11 of Decree No. 139/2018/ND-CP, the inspection centers will be suspended for 3 months if 2 or more inspectors have their inspection certificates revoked due to "being convicted by a legally effective court judgment for violating regulations related to the field of motor vehicle inspection" within 12 consecutive months.
This will cause 91 inspection centers in 32 localities to stop operating, leading to at least 36 localities nationwide at risk of traffic congestion for inspection. Including: Bac Kan, Bac Giang, Bac Ninh, Binh Dinh, Binh Duong, Binh Thuan, Can Tho, Da Nang, Dak Lak, Dong Nai, Dong Thap, Gia Lai, Ha Giang, Ha Nam, Hanoi, Ha Tinh, Hai Duong, Hau Giang, Hoa Binh, Hung Yen, Kon Tum, Lam Dong, Nam Dinh, Nghe An, Phu Yen, Quang Binh, Quang Nam, Quang Ngai, Son La, Thai Binh, Thai Nguyen, Thua Thien Hue, Tien Giang, Ho Chi Minh City, Tra Vinh and Tuyen Quang.
In particular, there will be localities where there are no more inspection centers to operate, such as Bac Kan and Thai Binh. This will lead to traffic congestion for vehicles coming for inspection in other localities due to the large movement of vehicles from the above 36 localities.
In order to proactively remove obstacles in motor vehicle inspection activities and prevent possible overload, the Ministry of Transport recommends that the Government develop and issue a Decree amending Decree 30/2023 and Decree 139/2018 according to simplified procedures, proposed to be issued in July 2024.
Proposal to amend regulations according to simplified procedures
The Ministry of Transport acknowledges: The recent incidents in the field of vehicle inspection are unprecedented. Many vehicle inspection centers have been suspended for a long period of time (over 12 months) due to many objective reasons such as: lack of personnel, repair and improvement of facilities, relocation, settlement of land procedures, fire prevention and fighting... and not due to violations leading to temporary suspension.
According to current regulations, the Certificate of Eligibility for Motor Vehicle Inspection Services must be revoked and can only be considered for re-issuance after 36 months from the date of revocation, leading to a shortage of inspection certificates causing great damage to people and businesses.
On the other hand, the process of handling administrative violations against violations in the technical safety and environmental protection (ATKT & BVMT) inspection of motor vehicles faces difficulties and obstacles due to the inconsistent names of the Certificate of eligibility for motor vehicle inspection activities prescribed in the Investment Law, Decree No. 139/2018/ND-CP and Decree No. 100/2019/ND-CP.
Some other issues arising in the practical implementation of the Decree include the lack of regulations on procedures for changing the owner of the inspection unit, changing the location of the inspection unit; responsibilities of organizations and individuals related to inspection activities; conditions for leaders of organizations establishing inspection units need to be supplemented to avoid possible violations in the field of motor vehicle inspection.
Therefore, the Ministry of Transport believes that it is necessary to consider amending and supplementing regulations soon to help the business of motor vehicle inspection services quickly stabilize, as well as limit unnecessary damage to people, businesses and society.
"In order to promptly resolve practical issues arising in motor vehicle inspection activities in the coming time, meeting the practical needs of society, the Ministry of Transport proposes that the Prime Minister allow the development and promulgation of a Decree amending and supplementing a number of articles of Decree No. 139/2018/ND-CP and Decree No. 30/2023/ND-CP of the Government according to simplified procedures in July 2024," the Ministry of Transport emphasized.
According to the Ministry of Transport, this proposal aims to handle congestion at the inspection centers in the coming time, helping the inspection system avoid disruption, ensuring to serve the urgent and legitimate needs of people and businesses, ensuring the construction and establishment of inspection units in accordance with the socio-economic development situation of localities, avoiding overload of inspection units in the coming time and unnecessary damage to society.
The Ministry of Transport said that in the past, although the Vietnam Register has provided guidance and solutions as well as continuously organized recruitment, inspection, assessment and issuance of certificates of eligibility for inspection activities for inspection units, strengthened training, assessment of new inspectors, trained professional staff, and trained up to 32 inspection staff assessment sessions (previously, only 4 to 5 assessment sessions were organized each year) to compensate for the above shortage.
Up to now, initial certificates have been issued to 297 motor vehicle inspectors; 5 training courses on vehicle inspectors have been organized for 251 qualified trainees; and inspection training has been organized for 209 professional staff.
However, the number of inspectors prosecuted is too large (over 900 people) while training a mechanical engineer to become an inspector requires a lot of time. Therefore, by the end of 2026, the motor vehicle inspection system will still not be able to compensate for the shortage of inspectors in the recent past.
