Encourage all economic sectors to invest in airports

(Chinhphu.vn) - The draft Law on Civil Aviation of Vietnam amends regulations on planning, investment and exploitation of airports in a flexible manner, consistent with the international common model, encouraging all economic sectors to participate in investment but still maintaining the leading role of state-owned enterprises in this key field.

The State unifies ownership of important infrastructure works; investors have the right to manage and exploit according to contract.

The Ministry of Construction has just submitted to the Government a draft Law on Civil Aviation of Vietnam (replacing the current law). The draft inherits and develops regulations that have been applied stably and effectively; at the same time, it amends and supplements them to implement the Party and State's policies and guidelines, in accordance with international treaties to which Vietnam is a member, to remove obstacles and create development momentum in the new period.

The Ministry of Public Security is the state management agency for aviation security.

Specifically, the Draft amends regulations related to Aviation Authorities and Aviation Security Authorities.

Accordingly, the draft clearly identifies the Ministry of Public Security as the state management agency for aviation security. The draft also clearly defines the tasks and powers of relevant authorities.

The draft amendments to the regulations allow civil aviation activities of the armed forces and state agencies to be carried out under this Law when there are no separate regulations. This clarifies the scope of application of the law, in accordance with the 1944 Chicago Convention, and at the same time creates a legal corridor for official flight activities in the context of modernizing the equipment of competent agencies.

A notable point is that the draft adjusts the regulations on signing labor contracts between aviation staff and employers to comply with the Labor Code, while ensuring flexibility in organizing human resources according to the international aviation market model.

Regarding aircraft management, exploitation and export, the draft was revised to ensure compliance with international treaties, improve the national credit rating according to the recommendations of the Aviation Working Group (AWG), thereby creating favorable conditions for Vietnamese airlines to access credit when leasing and purchasing aircraft.

Socialization of airport investment

The draft amends regulations on planning, investment and exploitation of airports in a flexible manner, consistent with international popular models. At the same time, it also encourages all economic sectors to participate in investment, maintaining the leading role of state-owned enterprises in this key field.

The established principle is that the State has unified ownership of important infrastructure works; investors are only entitled to manage and exploit according to the contract. The selection of investors is carried out in accordance with current laws on investment, bidding, and construction to ensure publicity and transparency, while meeting the requirements of national defense, security, and sovereignty.

The draft also amends regulations related to the obligations of carriers to clarify responsibilities and protect the rights of passengers when participating in air transport. This also contributes to improving service quality, regulating operations at airports, and reducing delays and cancellations.

Finally, the draft amends regulations related to general aviation, specialized aviation and commercial air transport. This classification will be synchronized with the Chicago Convention, helping to improve management, safety and operation of low-altitude airspace, thereby promoting socio-economic development.

The Ministry of Construction, as the agency in charge of the proposal assigned by the Government, has developed a draft Policy Profile for the Law on Civil Aviation of Vietnam in accordance with the provisions of the Law on Promulgation of Legal Documents in 2025.

The content of the policy consultation on the Law on Civil Aviation of Vietnam focuses on 5 major policy groups. Specifically: Completing the legal framework on State management of civil aviation; completing the legal framework on aviation safety; completing the legal framework on aviation security; completing the legal framework on airports; completing the legal framework on air transport.

Deputy Minister of Construction Le Anh Tuan emphasized that the development of the Law on Civil Aviation of Vietnam is necessary and urgent, aiming to institutionalize the guidelines and policies of the Party and State; meet the requirements of international integration, fully implement the obligations of a member state of the International Civil Aviation Organization (ICAO); remove bottlenecks, create new momentum for socio-economic development, international integration, and ensure national defense and security.
