Encroaching on streambed, punished but still repeat offense

On June 24, Mr. Le Van Nghieu, Chairman of the People's Committee of Trung Son Commune (A Luoi District) said that the unit had just sent a document to the People's Committee of A Luoi District asking for opinions on continuing to handle the case of an individual household encroaching and illegally constructing many structures in the A Lin stream area as a business location.

Previously, according to the people's reflection, currently in the A Lin stream area in Ta Ay Ta village, Trung Son commune, the business owner here has brazenly built many projects occupying the stream bed, built stone banks to change the flow and built many other projects around the area. The above illegal construction has destroyed the beauty and changed the current state of A Lin stream.

Through inspection, the People's Committee of Trung Son commune determined that the owner of the above illegal constructions is Mr. HGB (residing in Residential Group 2, A Luoi town, A Luoi district). For many months now, Mr. HGB has organized and built many illegal constructions occupying the streambed and some constructions in the upstream area about 500m from the location where people complained.

The People's Committee of Trung Son commune has established an interdisciplinary team to inspect and handle violations at the above business location. Accordingly, on May 10, 2023, a decision was made to impose an administrative penalty in the field of water and mineral resources with a fine of 3 million VND for the act of blocking the stream, obstructing the flow at A Lin stream, without a legal license as prescribed. At the same time, remedial measures were applied to force the removal of stream barriers and rocks, and objects obstructing the flow.

According to the People's Committee of A Luoi district, in the coming time, the district will continue to direct the People's Committee of Trung Son commune to conduct inspections, request the removal of illegal constructions at business locations in A Lin stream and strictly handle according to regulations if business households do not comply with the requirements of the inspection team.

It is known that this is the second time the Trung Son Commune People's Committee has decided to handle administrative violations against the above illegal construction site. Previously, this unit also administratively fined Mr. HGB for obstructing the flow and illegally constructing at A Lin stream with the amount of 2 million VND.

However, according to Mr. Le Van Nghieu, after many administrative penalties, requests to stop construction and dismantle the project, through supervision by local authorities, it shows that Mr. HGB continues to secretly build this business location as well as not comply with dismantling the illegally built construction items.

“On weekends when there are few people or at night, the project owner still secretly builds, making it difficult for local authorities to supervise. Therefore, the commune has submitted a report to the district People's Committee to continue asking for direction to completely handle this area,” Mr. Le Van Nghieu added.
