On the morning of November 21, Minister of Science and Technology Nguyen Manh Hung, authorized by the Prime Minister, presented to the National Assembly the draft Law on Artificial Intelligence.

This is the first time Vietnam has drafted and considered promulgating a separate law regulating AI.

AI products must be labeled.

Notably, the bill provides for transparency, labeling and accountability.

Accordingly, the vendor is responsible for ensuring that the AI ​​system is designed, operated and delivered in a manner that allows for identification, monitoring and accountability appropriate to the level of risk.

At the same time, provide the implementer with the information, technical guidance and data necessary for the implementer to fully perform its transparency, labelling and accountability obligations as prescribed by law.

The implementing party is responsible for clearly notifying users when the content created, edited or provided by the artificial intelligence system is subject to labeling as prescribed; and at the same time, labeling or transparently disclosing information as prescribed.

For products that are works of art or creative works, labeling shall be done in a manner that ensures it does not hinder the display, performance or enjoyment of the work.

Labeling is performed in the following cases:

Content created or edited by artificial intelligence systems that contains fake elements, simulates real people, real events, and is likely to mislead viewers, listeners, or readers into thinking it is real;

Content generated by artificial intelligence for the purpose of communication, advertising, propaganda or providing public information. Other cases as prescribed by the Prime Minister .

The bill also provides for handling violations and compensation for damages for organizations and individuals who violate the provisions of the law and other legal provisions related to artificial intelligence.

Accordingly, depending on the nature, level and consequences of the violation, administrative sanctions or criminal prosecution may be imposed; if damage is caused, compensation must be made according to the provisions of law.

Administrative sanctions for violations in the field of artificial intelligence shall be implemented in accordance with the following provisions and laws on handling of administrative violations.

Fine up to 2% of the organization's revenue in Vietnam of the previous year for violations of the provisions of Article 11 of this law.

In case of repeat offense, the maximum fine is 2% of the organization's global turnover of the immediately preceding year.

In case there is no revenue of the previous year or the fine calculated based on revenue is lower than the maximum fine prescribed in Point b below, the fine prescribed in Point b below shall apply;

For violations not specified in Article 11 of the law, the maximum fine is 2 billion VND for organizations; for individuals committing the same violation, the maximum fine is half the fine for organizations.

Presenting the project review, Chairman of the National Assembly's Committee on Science, Technology and Environment Nguyen Thanh Hai said that the Committee found that labeling AI-generated products aims to ensure transparency and users' right to know (to help information recipients clearly know that the content was created by AI, not humans).

Labeling also aims to prevent fraud and misinformation (helping limit the use of AI to create fake news, distort, manipulate public opinion, or forge statements of individuals and organizations).

Along with that, increasing the responsibility of organizations/individuals deploying AI (helping to identify the origin of content, supporting tracing when risks or disputes related to copyright, authenticity or negative impacts occur)...

Thus, labeling has ethical and legal responsibilities to build trust in the AI ​​era.

Accordingly, the Committee on Science, Technology and Environment basically agrees with the labeling provisions in the bill.

However, the Committee recommends referring to international experience on AI-generated products to ensure suitability with Vietnam's practical conditions.

"For products and hardware devices with AI applications (such as refrigerators, TVs, washing machines, etc.), it is recommended to research and consider applying invisible watermarks to reduce costs and procedures while still ensuring management and traceability," Ms. Hai said.

At the same time, the Committee also proposed to stipulate in the draft law the principles for the Government to provide detailed instructions on forms, technical standards and exemptions.

"There are suggestions to change the labeling regulation from mandatory to encouraged, with minimum technical guidance; pilot a voluntary labeling mechanism in some fields; and at the same time increase communication to avoid misunderstandings that no label means it is not an AI product," said Ms. Hai.
