Lien Chieu District responds to complaints about the decision to adjust the planning of the New Danang City Project

Regarding people's complaints about the decision to adjust the planning of the New Danang City Project, the People's Committee of Lien Chieu District said that it needs time to review, inspect and verify.

Status of the Project of Commercial Service Complex, Apartments and Residential Land.

According to the Citizen Reception Committee (Office of the People's Committee of Lien Chieu District, Da Nang ), from May 31, 2024, the People's Committee of Lien Chieu District received many complaints from households who are partners of Phu Gia Thinh Housing Investment and Trading Joint Stock Company (hereinafter referred to as Phu Gia Thinh Company) at the Hoang Van Thai Commercial Service Complex, Apartment and Residential Land Project (New Danang City Project).

Content of the first administrative complaint against Decision No. 1763/QD-UBND dated April 9, 2024 of Lien Chieu District People's Committee on approving the adjustment of the detailed planning at a scale of 1/500 of the Commercial Service Complex, Apartments and Residential Land (supplementing the dossier).

Responding to the content of the complaint, the Citizen Reception Committee said that this is a complicated case that requires time to review, check and verify.

Therefore, the District People's Committee has assigned specialized departments and offices to urgently check and review relevant records and documents to have a basis for handling complaints of households in accordance with regulations.

Document sent to households who are partners of Phu Gia Thinh Company by the Citizen Reception Committee was signed on June 11, 2024.

In addition to the written response with the above content from the Citizen Reception Committee, Mr. PTH (residing in Hoa Khanh Nam ward, Lien Chieu district, a land buyer at the project) said: "After the residents' complaint, until July 4, everything was quiet and nothing was said."

Previously, on May 20, 2024, in a complaint sent to the People's Committee of Lien Chieu District, people said that Decision No. 1763/QD-UBND dated April 9, 2024 issued by the People's Committee of this district overlapped with the detailed planning approved in Decision No. 3748/QD-UBND dated June 11, 2016, causing people to not receive 531 plots of land and red books...

In the legal basis for the decision to adjust the planning, Lien Chieu District People's Committee relied on 4 documents related to the content of the proposed planning adjustment on March 15, 2024 and April 2, 2024 (including 2 submissions, 1 report, 1 official dispatch) of Phu Gia Thinh Company (the time from the proposal to approval was less than 1 month).

On June 21, 2024, 2 members invited to join the Supervisory Team (established under Decision No. 80, dated December 7, 2022 of the People's Committee of Da Nang City), Tran Duc Manh and Phan Ngo Doan Trung, submitted a request to provide information related to the Project of Phu Gia Thinh Company to the Head of the Supervisory Team; and also sent it to the People's Council, People's Committee, and Citizen Reception Committee of the People's Committee of Da Nang City.

Of the 4 contents of the request for information, the first content is an excerpt, providing 2 documents including Notice No. 89/TB-VP, dated March 13, 2024, the conclusion of the Chairman of the City People's Committee Le Trung Chinh at the meeting on March 6, 2024 on handling the request of the Department of Planning and Investment related to the project of Phu Gia Thinh Company and Official Dispatch No. 2124, dated April 1, 2024 of the Department of Construction on the opinion on the dossier of adjusting the detailed planning of the complex of commercial services, apartments and residential land.

These are also two documents mentioned by the People's Committee of Lien Chieu District in the legal basis of Decision No. 1763. At the same time, in Document No. 125, dated June 4, 2024, Phu Gia Thinh Company mentioned that the announcement of planning adjustment information is implemented according to Notice No. 89.

Regarding the remaining 3 contents, people questioned the financial capacity of Phu Gia Thinh Company in implementing the project (according to the plan of continuing cooperation, the plan of terminating the contract, if not capable of implementing, what will be the sanctions...).

According to the public list of tax enforcement by the Da Nang City Tax Department, the Debt Notice period of April 2024, Phu Gia Thinh Housing Investment and Trading Joint Stock Company had its account enforced with the amount of VND 179,519,226,858 (effective from May 25 to June 23).
