The Law on Consumer Protection 2023 officially takes effect from July 1, 2024

Also on this day in 2011, the Law on Consumer Protection 2010, the first law on consumer protection in Vietnam, came into effect. In the context of many changes in the socio-economic situation, many new forms of business and consumption trends have emerged, directly affecting the rights and interests of consumers, causing many difficulties and inadequacies, and some provisions of the Law on Consumer Protection 2010 are no longer suitable for practice. Therefore, the Law on Consumer Protection 2023 was issued to perfect the institution on consumer protection, ensuring stability, unity, synchronization, and feasibility; at the same time, creating more motivation to promote and perfect a safe and quality consumer environment, increasing competitiveness so that businesses can develop and build a healthier and more transparent business environment for consumers. The Law on Consumer Rights Protection 2023 also adds new regulations to support and encourage the activities of social organizations, improve the efficiency and effectiveness of state management of consumer rights protection, contribute to promoting the economic, cultural and social development of the country, in time with the international integration process of Vietnam and the region.

The Law on Consumer Rights Protection 2023 ( see here ) consists of 7 Chapters with 80 Articles, clearly regulating the principles and policies on consumer rights protection; rights and obligations of consumers; responsibilities of business organizations and individuals towards consumers; consumer rights protection activities of agencies and organizations; dispute resolution between consumers and business organizations and individuals; state management of consumer rights protection. In order to effectively implement the Law on Consumer Protection and promptly bring the law into life, in recent times, the Ministry of Industry and Trade has presided over the development and submission to competent authorities for promulgation of legal documents detailing and guiding the implementation of the law, including:

(i) Decree No. 55/2024/NDCP dated May 16, 2024 of the Government detailing a number of articles of the Law on Protection of Consumer Rights (effective from July 1, 2024) ( see here );

(ii) Decision No. 07/2024/QD-TTg dated June 20, 2024 of the Prime Minister promulgating the List of products, goods and services subject to registration of standard contracts and general transaction conditions (effective from July 1, 2024) ( see here );

(iii) Decree amending and supplementing a number of articles of Decree No. 98/2020/ND-CP dated August 26, 2020 of the Government regulating administrative sanctions for violations in commercial activities, production and trading of counterfeit and prohibited goods and protection of consumer rights (amended and supplemented by Decree No. 17/2022/NDCP dated January 31, 2022). The Ministry of Industry and Trade is carrying out procedures as prescribed to submit to the Government for promulgation of this draft Decree.

In addition, in order to propagate and disseminate the Law on Consumer Rights Protection to the people, cadres, civil servants, public employees and workers; provide training and professional development for cadres, civil servants, public employees and workers to carry out consumer rights protection work; raise awareness and sense of responsibility of people in complying with this Law, the Ministry of Industry and Trade has submitted to the Prime Minister Decision No. 1012/QD-TTg dated August 31, 2023 of the Prime Minister promulgating the Plan to implement the Law on Consumer Rights Protection (see here ). Then, on October 17, 2023, the Minister of Industry and Trade issued the Plan of the Ministry of Industry and Trade (attached to Decision No. 2720/QD-BCT dated October 17, 2023) to implement Decision No. 1012/QD-TTg dated August 31, 2023 of the Prime Minister promulgating the Plan to implement the Law on Consumer Rights Protection.

In the coming time, the Ministry of Industry and Trade will proactively and strengthen the implementation of propaganda, dissemination and training activities on consumer rights protection laws, targeting a large number of consumers, agencies and organizations from central to local levels to raise people's awareness of consumer rights protection.
