This is the basic new point of Decree No. 33/2023/ND-CP recently issued by the Government , regulating commune-level cadres, civil servants and non-professional workers at the commune, village and residential group levels.
Commune-level cadres and civil servants who graduate with training qualifications according to standards are classified as administrative civil servants.
Salary as administrative civil servant
According to the new decree effective from August 1, commune-level officials and civil servants who graduate with training qualifications according to standards will be paid the same as administrative civil servants with the same training qualifications.
In case during the working period, commune-level cadres and civil servants have changes in training level suitable for the current position and title, they can request the Chairman of the District People's Committee to arrange salary according to the new training level from the date of graduation certificate issuance.
Commune-level cadres are entitled to leadership position allowances compared to the basic salary, specifically: Party Committee Secretary is 0.30; Deputy Party Committee Secretary, Chairman of the People's Council, Chairman of the People's Committee is 0.25; Chairman of the Fatherland Front Committee, Vice Chairman of the People's Council, Vice Chairman of the People's Committee is 0.20; Secretary of the Ho Chi Minh Communist Youth Union, Chairman of the Women's Union, Chairman of the Farmers' Association, Chairman of the Veterans' Association is 0.15.
Because the Law on Cadres and Civil Servants has not been amended or supplemented, the Decree supplements regulations on concurrent allowances in the following direction: commune-level cadres and civil servants who concurrently perform the duties of non-professional workers at the commune level shall receive a concurrent allowance equal to 100% of the allowance prescribed for the concurrent position.
In case of holding multiple positions, only the highest concurrent allowance is received.
The District People's Committee decides on the positions entitled to concurrent allowance in cases where the number of positions arranged for concurrent holding is greater than the number of cadres and civil servants reduced compared to the number assigned according to the provisions of this Decree.
In addition, commune-level cadres and civil servants who hold concurrent positions are also given allowances for holding concurrent positions and titles that are not used to calculate social insurance and health insurance contributions and benefits.
Allowance for non-professional workers
For part-time workers, the decree stipulates an increase in the allowance fund for part-time workers in each commune-level administrative unit.
Accordingly, type I commune-level administrative units are allocated an allowance fund equal to 21.0 times the basic salary; type II commune-level administrative units are allocated an allowance fund equal to 18.0 times the basic salary; type III commune-level administrative units are allocated an allowance fund equal to 15.0 times the basic salary.
In addition to this allowance fund level, for commune-level administrative units with a population size and natural area higher than the prescribed standards, if they are allowed to increase non-professional workers, for every increase of 1 non-professional worker compared to the regulations, the allowance fund will be increased by 1.5 times the basic salary/1 additional person.
For each type of village and residential group, the allowance fund level is increased from 3.0 - 5.0 times the basic salary to 4.5 - 6.0 times the basic salary. Of which, the level of 6.0 times the basic salary applies to villages with 350 households or more; residential groups with 500 households or more; villages and residential groups belonging to key commune-level administrative units with complicated security and order according to the decision of competent authorities and villages and residential groups belonging to border and island commune-level administrative units.
The lump sum of 4.5 times the basic salary applies to the remaining villages and residential groups. For district-level administrative units that do not have commune-level administrative units, villages and residential groups are determined according to that district-level administrative unit.
The Decree stipulates that the Provincial People's Committee shall submit to the People's Council of the same level for specific regulations on allowance levels for each position of non-professional workers at the commune, village and residential group levels. Specific regulations on fixed operating expenses of socio-political organizations at the commune level and monthly support levels for people directly participating in activities in villages and residential groups do not require consultation with ministries and central agencies.
