Further improve the effectiveness of citizen reception, complaint and denunciation settlement

The work of receiving citizens and resolving complaints and denunciations in Binh Thuan province has had positive changes. This result depends largely on the awareness, responsibility and determination of leaders of Party committees and authorities at all levels.

The situation of complaints and denunciations tends to decrease.

Assessing the leadership and direction of citizen reception, complaint and denunciation settlement in 2023, Report No. 493-BC/TU of Binh Thuan Provincial Party Committee emphasized: “This content has been paid attention to by Party committees at all levels, leaders of agencies, units and localities in the province, focusing on implementation and achieving many positive results. Compared to 2022, the situation of complaints and denunciations tends to decrease. The number of citizens registering to receive citizens has decreased in terms of the number of visits, the number of people and the number of people (including: a decrease of 410 visits, a decrease of 471 people; a decrease of 8 visits and 65 people); cases of complaints and denunciations that are pending, complicated and prolonged continue to be focused on by all levels and functional branches, contributing to stabilizing political security and ensuring social order and safety in the province”.

The above results were achieved thanks to the attention of Party committees, authorities, localities, especially leaders, in implementing the work of receiving citizens in accordance with legal regulations. Through this activity, it has contributed to improving the effectiveness of handling citizens' complaints and denunciations, protecting the legitimate rights and interests of citizens, limiting the situation of prolonged complaints and denunciations beyond the level, causing insecurity and disorder in the locality. For example, the reception of citizens by the head of the Party Committee according to Regulation No. 11-QDi//TW, received 432 meetings/483 people; of which, the Provincial Party Secretary periodically received 10 meetings/18 people and had 1 dialogue with the people of Ham Thuan Bac district (420 people)...

The main contents of citizen reception are related to the issuance of land use right certificates, revocation of land use right certificates; acts of encroachment on public land, road corridor land, and frontage land; guidance on procedures for granting land use right, procedures for changes in agricultural land area; slow settlement of petitions, enforcement of civil judgments, decisions on administrative sanctions, decisions on applying coercive measures to enforce decisions on applying remedial measures; reclaiming old land; compensation, support and resettlement when land is recovered, etc.

Regarding the settlement of complaints and denunciations, Party committees, authorities and localities have also focused on handling and resolving complaints and denunciations in accordance with the law. Through the settlement of complaints, the legal rights of a number of cases have been restored; violations have been discovered through the settlement of denunciations for handling in accordance with the law. Focus has been placed on inspecting, reviewing and resolving outstanding, complicated and prolonged complaints.

However, in addition to the achievements, the work of receiving citizens and handling complaints and denunciations still faces limitations and difficulties. It is worth mentioning that the work of inspecting and urging the implementation of some decisions on handling complaints and conclusions on handling denunciations that have come into legal effect has not been fully implemented at times. Organizing the implementation of decisions on handling complaints and conclusions, decisions on handling denunciations that have come into legal effect for individuals is very difficult to implement, especially when it comes to recovering assets. Citizens still send petitions to multiple agencies and units; some cases are being resolved but citizens continue to send petitions...

Increase leadership responsibility

The Provincial Party Committee has also forecasted that in the coming time, together with the implementation of the province's socio-economic development strategy, there will be many opportunities and advantages; however, the prosecution of cases, temporary detention, review and handling of a number of cadres and party members who have committed violations in the management and administration of land will cause negative public opinion; the security and order situation has many potential complications. The implementation of many large projects related to the management and use of land, minerals, and the environment; public investment; budget finance, public asset procurement: compensation, resettlement, healthcare... has the potential risk of corruption, negativity, and waste if there are no timely preventive measures. Administrative reform is still limited and not really drastic, especially in administrative procedure reform, increasing the risk of delays and slow resolution of administrative records, leading to the emergence of petitions from people and businesses...

Therefore, Party committees, Party organizations, heads of agencies, units and localities must regularly review, supplement and develop regulations and rules related to the work of receiving citizens, handling complaints and denunciations, identifying the work of receiving citizens, handling complaints and denunciations as a key and regular task. In particular, it is necessary to further enhance the responsibility of each Party committee, government, locality, each cadre, Party member, civil servant, and public employee, especially the leader in receiving citizens and handling complaints and denunciations; focus on handling complaints and denunciations arising under the authority and assigned by superiors on schedule and within prescribed time. In addition, it is necessary to maintain discipline and order; strengthen state management in sensitive, complicated areas, prone to corruption and negativity, such as: Land, resources, minerals, environment...

It is necessary to grasp the situation and focus on coordinating timely resolution right from the grassroots level and when complaints first arise, minimizing the situation of complaints that go beyond the level, are crowded, and cause complications for security and order; focus on dialogue, education, and persuasion of people in the work of resolving complaints and denunciations, especially collective complaints. Strictly handle violations in accordance with the law.

In addition, strengthen the inspection of the responsibility of leaders in implementing legal regulations on citizen reception, complaint and denunciation settlement, and land disputes in order to promptly detect errors in implementation. Thereby further improving the quality and effectiveness of citizen reception and complaint and denunciation settlement. Continue to implement well the publicity and transparency in handling complaints and denunciations, especially publicizing the complaint and denunciation settlement process on mass media, electronic information pages of agencies and units in accordance with regulations for organizations and citizens to monitor, supervise and serve the direction and management of handling complaints and denunciations.
