On June 29, Thanh Oai District People's Court, Hanoi opened a trial for the case of "Intentionally causing injury", sentencing defendant Nguyen Thi Tien (46 years old, in Bich Hoa commune, Thanh Oai district) to 6 months in prison.
The victim in the case is Ms. Nguyen Thi T. (born in 1972, a neighbor of defendant Tien).
According to the indictment and the trial, at around 8:00 a.m. on February 8, defendant Nguyen Thi Tien was holding a 1.16m stainless steel broom to sweep the alley in front of her house when she got into an argument and then got into a fight with Ms. Nguyen Thi T. - a neighbor in the same village, the cause of which was that defendant Tien kept a dog that made the alley unsanitary.
Defendant Tien used a broom to hit the victim's head, face, and biceps many times, causing Ms. T. to have torn skin, bleeding on her left chin, bruised biceps, and fall to the street.
After being taken to the emergency room, Ms. T. was diagnosed with a concussion, a wound on her left chin (required 5 stitches), and had to be treated at Military Hospital 103 from February 8 to February 20.
On April 4, Ms. T. filed a request to initiate criminal proceedings. According to the injury assessment, Ms. T. suffered 10% injury.
The victim was assaulted by a neighbor and had to be treated in hospital.
At the trial, the defendant denied causing injury to the victim. The representative of the Procuracy questioned whether the defendant was forced to confess or not, and the female prosecutor who took Tien's statement both showed that she voluntarily confessed to "causing injury" to the victim.
Ms. T. testified in court: On February 8, when she swept the yard, she met defendant Tien and mentioned that the defendant had let the dog loose in the alley, causing Ms. T. to have to clean it many times. "At that time, Tien cursed and used a broom handle to knock me unconscious on the street. When I woke up, I saw that my husband was taking care of me," said the victim T.
The panel of judges determined that the defendant Tien did not confess honestly and did not show remorse. Considering the defendant's testimony and the documents and evidence, the panel of judges had sufficient grounds to affirm that: On February 8, at Alley Giua 1, Tren village, Bich Hoa commune, Thanh Oai district, Hanoi, the defendant used a stainless steel broom handle to hit the victim many times on the head and face, causing the victim to suffer 10% damage to his health. The defendant's actions constituted the crime of "Intentionally causing injury". The indictment against the defendant was completely accurate, correct in person, and in accordance with the law.
Considering the nature of the case, the panel of judges determined that this was a dangerous case for society, the defendant's actions harmed the health of others, showing disregard for the law, so a strict sentence was needed as a deterrent.
The panel sentenced defendant Nguyen Thi Tien to 6 months in prison and declared that the defendant was responsible for compensating Ms. T. for medical examination and treatment costs and medicine costs of 40 million VND.
