Many fundamental changes

According to Mr. Nguyen Duc Thanh, Deputy Director of the Ca Mau Provincial Department of Finance, compared to the previous Decree 01/2021/ND-CP, Decree 168 brings about many fundamental changes to support businesses in more easily registering their establishment and changing their operational information. One of the highlights is the shift in management authority and stronger decentralization. Currently, the provincial-level business registration agency (Business Registration Department) under the Department of Finance directly receives and processes business registration applications in the province. At the commune level, the authority to issue business registration certificates for cooperatives and household businesses is handled by the Economic Department or the Economic - Infrastructure and Urban Department of the commune People's Committee, instead of the district-level Finance - Planning Department as before.

In addition, online business registration is encouraged and implemented synchronously. From July 1st, businesses can complete the entire registration process through the National Public Service Portal using an electronic identity account. “When submitting applications online, businesses no longer need to include copies of personal documents as before. Electronic documents have the same legal validity as paper documents, saving time and costs and encouraging the use of online public services,” Mr. Thanh stated.

Notably, Decree 168 also reduces the requirement for seals in registration documents and clarifies regulations on beneficial owners, in line with international practices in anti-money laundering.
