Jobs prohibited for workers from 15 years old to under 18 years old

Specifically:

1. It is prohibited to employ workers from 15 years old to under 18 years old to do the following jobs:

a) Carrying, lifting, or carrying heavy objects beyond the physical capacity of minors;

b) Production and trading of alcohol, wine, beer, tobacco, psychoactive substances or other addictive substances;

c) Production, use or transportation of chemicals, gases, explosives;

d) Maintenance and repair of equipment and machinery;

d) Demolition of construction works;

e) Cooking, blowing, casting, rolling, stamping, welding of metals;

g) Diving, offshore fishing;

h) Other work that is harmful to the physical, mental and personality development of minors.

2. It is prohibited to employ workers from 15 years old to under 18 years old in the following places:

a) Underwater, underground, in caves, in tunnels;

b) Construction site;

c) Livestock slaughterhouse;

d) Casinos, bars, dance clubs, karaoke rooms, hotels, motels, saunas, massage parlors; lottery business locations, electronic game services;

d) Other workplaces that cause harm to the physical, mental and personality development of minors.

3. The Minister of Labor, War Invalids and Social Affairs shall prescribe the list at Point h Clause 1 and Point d Clause 2 of this Article.

Regarding working hours, workers under 15 years old cannot work more than 4 hours a day and 20 hours a week; cannot work overtime or work at night. People from 15 to under 18 years old cannot work more than 8 hours a day and 40 hours a week. People from 15 to under 18 years old can work overtime or work at night in certain occupations and jobs according to the list issued by the Minister of Labor, War Invalids and Social Affairs (MOLISA).

Principles of using minor labor

The 4 principles when using minor labor, stipulated in the 2019 Labor Code, are:

1. Minor workers are only allowed to do work that is suitable for their health to ensure physical, mental and personality development.

2. When employing minors, employers are responsible for taking care of their employees in terms of labor, health, and education during the working process.

3. When employing minors, the employer must have the consent of the parent or guardian; establish a separate logbook, recording full name, date of birth, current job, results of periodic health checks and present it when requested by a competent state agency.

4. Employers must create opportunities for minor workers to receive cultural education, vocationaleducation , training, fostering, and improvement of vocational skills.
