According to the indictment, Mr. Nguyen Quang Tuan (former Director of Hanoi Heart Hospital) took advantage of his position and power to illegally intervene in bidding activities, causing damage to Hanoi Heart Hospital and the social insurance fund of more than 53 billion VND.
Mr. Tuan's actions violated the crime of "Violating bidding regulations causing serious consequences", stipulated in Clause 3, Article 222 of the 2015 Penal Code. Accordingly, committing a crime causing damage of 1 billion VND or more is punishable by imprisonment from 10 to 20 years.
The prosecution's view is that, in recent times, many corruption cases have been brought to trial with the criterion of no forbidden zones; including many cases of large scale and complexity, with defendants holding high positions.
This case is a typical illustration of group interests, collusion between state unit leaders and enterprises, infringing on the legitimate interests of state agencies, and undermining people's trust in the Party and the State.

Mr. Nguyen Quang Tuan's criminal acts caused a loss of more than 53 billion VND. The defendant is the head and responsible for all activities at Hanoi Heart Hospital, playing the role of mastermind, and the acts were determined to have caused particularly serious consequences.
However, considering that the defendant is remorseful, during the investigation and at court, the defendant confessed honestly, has remedied the consequences of more than 6 billion VND; the defendant has many achievements and is a people's doctor... the representative of the People's Procuracy proposed to give the defendant a low sentence, demonstrating the leniency of the law. The representative of the People's Procuracy proposed to sentence the former Director of Hanoi Heart Hospital to 4-5 years in prison.
Defending his client, Mr. Tuan's lawyer said that the main reason for defendant Nguyen Quang Tuan's violations in the 4 bidding packages in 2017 was due to haste, fear that the hospital would run out of supplies and chemicals to promptly treat people.
Opportunity to practice again
Given the right to have the last word, the former Director of Hanoi Heart Hospital did not defend his criminal behavior, only hoping that the court would have a more humane assessment, allowing the defendant to soon return to his family and society, continue to contribute, do scientific research, and train many highly qualified cardiologists.
On the afternoon of April 21, the People's Court sentenced Mr. Nguyen Quang Tuan to 3 years in prison for "violating bidding regulations causing serious consequences". It can be said that this is a lenient sentence for Mr. Nguyen Quang Tuan.

In making the above verdict, the panel of judges stated that the defendant Nguyen Quang Tuan is a leading expert in cardiovascular treatment, the defendant has been awarded many noble medals, awards, and certificates of merit; he is a professor, an outstanding citizen of the capital, a former National Assembly delegate, has saved many lives and has been praised by the people. This is the defendant's contribution.
The defendant’s crime occurred at a time when the health sector was facing difficulties, however, the defendant confessed honestly, admitted his guilt, and paid the amount of 10,000 USD. In this case, the defendant was not responsible for compensation, but defendant Tuan voluntarily paid 6 billion VND.
The defendant's actions are not related to medical expertise, so it is necessary to consider significantly reducing the defendant's sentence so that he can soon return to the community and contribute more to society.
Because the crime of "Violating bidding regulations causing serious consequences" does not apply additional penalties, Mr. Nguyen Quang Tuan is not banned from practicing.
Mr. Tuan was detained since December 10, 2021. With the lenient sentence as announced by the People's Court, if he reforms well, the former Director of Hanoi Heart Hospital will have the opportunity to practice again to save people, as a way for him to atone for the mistakes he has made.
