Overview of the Discussion Session at Group 9

Group 9 consists of 26 delegates from the National Assembly Delegation of the provinces: Quang Ninh, Quang Ngai, Phu Yen, Ben Tre . Head of the National Assembly Delegation of Phu Yen province Pham Dai Duong, Head of Group 9, moderated the discussion.

Through discussion, opinions at Group 9 agreed on the need to amend the Law on Water Resources to further improve the synchronous and unified legal corridor, ensuring transparency to be able to exploit water resources to the maximum, allocate them reasonably and use them effectively; ensure national water security; focus on preventing, controlling and restoring degraded, depleted and polluted water sources; clearly define the responsibilities for water resource management and the responsibilities for managing water exploitation works at both central and local levels to overcome overlaps and legal conflicts.

Commenting on this Law project, delegate Duong Binh Phu - Delegation of National Assembly Deputies of Phu Yen province was interested in Clause 24, Article 3 explaining the operation of reservoirs in real time, requesting clarification of the period of time "real time" here because the time to calculate the results to make decisions on operating hydroelectric reservoirs depends not only on the real-time forecast time but also on the algorithm (calculation software), computer configuration to run the model and the experience of the operator.

Regarding the regulations on the State's policy on water resources, delegate Duong Binh Phu proposed to supplement mandatory policies for the treatment of large-scale urban and industrial wastewater, in which it is necessary to consider adding a provision for the Government to consider deciding on the scale/capacity/characteristics/type of facilities/systems that must implement the goal of reusing treated wastewater and using it appropriately for the purposes.

Regarding prohibited acts, delegate Duong Binh Phu proposed adding the phrase "exploitation activities that harm aquatic ecosystems", because in reality, there are currently aquatic exploitation activities that use substances or objects that greatly affect the underwater ecosystem and water environment when exploiting aquatic products (electric shock, explosives, etc.).

In addition, delegate Duong Binh Phu proposed to review and consider the necessity of issuing many water resources plans as at present and to avoid duplication and overlap with other plans. Regulations on water resources planning include: National water resources planning, Integrated planning of inter-provincial river basins, inter-provincial water resources and Planning for protection, exploitation and use of international water resources under the National Planning System. According to the draft Proposal, after the Law on Planning No. 21/2017/QH14 takes effect, localities have been and are building and integrating water resources content into provincial planning according to regulations.

Also interested in this Law project, delegate Le Dao An Xuan - National Assembly Delegation of Phu Yen province commented on Article 8 on the list of ponds, lakes, lagoons and lagoons that cannot be filled. The delegate said that the question is whether the reduction of the area and volume of the lake can be applied if they are not filled. He suggested that the drafting agency should clarify and further study this content.

Regarding the prohibited acts in Article 10, which prohibits the discharge of wastewater into underground water sources, delegate Le Dao An Xuan said that this is very difficult to implement in practice. The 2012 Law on Water Resources allows wastewater discharge into places with ponds, lakes, lagoons, estuaries, and rivers, but in mountainous areas without the above aquatic resources, discharge into underground water sources is prohibited, even reuse for watering plants is prohibited, making it very difficult to treat this wastewater source. This case is often encountered in livestock farms located in mountainous areas.

Article 29 of the draft also reiterates the same provision as Article 10, so delegate Le Dao An Xuan suggested that the Ministry of Natural Resources and Environment should clarify this criterion. Because if wastewater is treated to meet surface water standards according to regulations, it will require a very large cost, while currently there are many specialized regulations on reusing wastewater after livestock farming to serve forestry and agricultural projects, which can be reused economically, considering it as an input source, applying in accordance with the circular economy regulations for water use.

Regarding Article 20, delegate Le Dao An Xuan said that one of the contents that needs to be adjusted is that if newly formed national key projects and programs affect water resources, the planning must be adjusted. The delegate expressed concern about which planning and strategy should be used when implementing these projects to ensure that these projects and works are met. He suggested that the Drafting Committee consider further.

Regarding the regulation and distribution of water resources in Article 36, delegate Le Dao An Xuan stated that the draft stated "consideration based on water resource scenarios, using support tools" which was confusing, and suggested adding content to consult the community of scientists and local authorities when implementing the regulation and distribution of water resources.

Regarding the fee for granting the right to exploit water resources (Article 66), there are opinions suggesting clarifying the subjects that must pay the fee for granting the right to exploit water resources as prescribed in Clause 1 and Clause 2; clarifying the addition of regulations on collecting fees for granting the right to exploit water resources for agricultural production because this field is currently carried out by state-owned enterprises and irrigation fees are still being supported by the State; specifying the collection principles, calculation methods of resource tax and fees for granting the right to exploit water resources.

Basically agree with the regulations on the responsibility of state management of water resources of the Government, Ministries, ministerial-level agencies, and People's Committees at all levels in Articles 76 and 77 of the draft Law. However, opinions suggest that it is necessary to clearly distinguish the responsibility of water resources management from the management of water exploitation and use works of Ministries and branches; supplement regulations on the coordination mechanism between the Ministry of Natural Resources and Environment and other Ministries related to water exploitation and use so that management is unified, synchronized, avoiding overlap, causing waste of resources and omission of management areas.

Proposed opinions on the state management responsibilities of the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, and the Ministry of Construction (Clause 3, Clause 4, Clause 5, Article 76) need to be more specific, adding the responsibilities of the Ministry of Foreign Affairs, the Ministry of Public Security, and the Ministry of National Defense related to water resources, cross-border water security, water resource protection, and ensuring the safety of dams and reservoirs.
