Continuing the 28th Session, on the morning of December 18, the National Assembly Standing Committee considered the proposal to add 4 draft laws to the 2024 Law and Ordinance Development Program.
These draft laws include the Law on Prevention and Combat of Human Trafficking (amended), the Law on Chemicals (amended), the Law on Value Added Tax (amended), and the Law on Management of Weapons, Explosives and Support Tools (amended).
Regarding some opinions on the draft Law on Management of Weapons, Explosives and Support Tools (amended), discussed at the meeting, Chairman of the National Defense and Security Committee Le Tan Toi said that in fact, out of 40,000 crimes related to weapons and explosives, over 58% of the cases involved the use of knives and rudimentary weapons, very serious crimes such as murder, kidnapping, drugs, intentional injury, and resisting law enforcement officers. Among these cases, many police officers and soldiers on duty were injured and sacrificed.
"Therefore, in reality, it is very necessary to amend this Law project," Mr. Le Tan Toi emphasized and proposed to pass this Law project in a shortened session.
Agreeing with the Government's proposal on comprehensively amending the Law on Chemicals, however, Chairman of the Committee for Science , Technology and Environment Le Quang Huy said that "it is necessary to further assess the impacts." Accordingly, the issue of chemical management according to the life cycle needs to be reviewed, and the functions and tasks of the State management agencies assigned this task need to be further assessed. Solutions on resources for implementation to avoid overlap also need to have an impact assessment and must be further clarified.
Commenting on the draft Law on Prevention and Combat of Human Trafficking (amended), Chairwoman of the Judicial Committee Le Thi Nga expressed her agreement with the need to amend the Law. After more than 10 years of implementation, the Law has created a favorable legal basis for competent authorities in the fight against human trafficking, supporting victims of trafficking and has achieved many positive results. However, the implementation of the Law has also revealed a number of shortcomings, difficulties and inadequacies that need to be amended and supplemented.
In addition, the Party's viewpoint on crime prevention and control in the new situation also needs to be institutionalized. The Constitution and related laws have been amended. Therefore, this Law also needs to be amended to ensure the consistency of the legal system, in accordance with international treaties to which Vietnam is a member.
“The Judicial Committee recommends that the agency in charge of drafting the proposal should continue to add opinions from the Central Committee of the Vietnam Women's Union, the agency assigned to propagate the work of preventing and combating trafficking in women and children, and a number of other relevant ministries, branches and localities," Ms. Le Thi Nga emphasized.
Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue noted that the submission of draft laws must be calculated in general. Resolutions on the Law and Ordinance Development Program should clearly stipulate that in the process of researching and perfecting the law development, in cases where new policies arise or there are amendments or supplements to the stated policies, the impact must be carefully assessed and the process of promulgating legal documents must be strictly followed.
Regarding specific contents, National Assembly Chairman Vuong Dinh Hue stated that the draft Law on Chemicals (amended) is closely related to and has a great impact on production, consumption, crime prevention and control... so it is necessary to seek opinions and assess the impact very carefully, especially the opinions of consumer associations, the Vietnam Federation of Commerce and Industry (VCCI), and agencies representing producers and consumers.
"We should not set out regulations that make it difficult for businesses and people in this process," National Assembly Chairman Vuong Dinh Hue emphasized, noting that "the scope of the Chemical Law project has overlapping issues of state management that need to be carefully addressed," "we need to try to legalize the major contents contained in the decrees."
Regarding the draft Law on Value Added Tax (amended), the National Assembly Chairman expressed concerns about the scope of regulations on goods subject to value added tax (VAT), especially for agricultural products, and noted that VAT regulations are contained in many different decrees, so it is necessary to review and legalize them to the maximum extent, avoiding the situation of "framework laws, pipe laws," especially for tax laws. VAT refunds are also an issue that needs attention.

Fully absorbing the opinions of members of the National Assembly Standing Committee regarding the draft Law on Chemicals (amended), Deputy Minister of Public Security Nguyen Duy Ngoc said that regarding precursors for drug production, the recent Interpol conference also mentioned this issue. New types of synthetic drugs cause dangerous harm to society.
The issue of human trafficking has also become complicated, especially after the COVID-19 pandemic, with criminals taking advantage of the migration wave to traffic people and commit crimes.
Regarding the draft Law on Value Added Tax (amended), major cases are currently showing legal loopholes, so the Ministry of Public Security will work with the Ministry of Finance and the Ministry of Planning and Investment to connect business data and tax data, along with population data to resolve current concerns.
Regarding the draft Law on Management of Weapons, Explosives and Support Tools (amended), Deputy Minister Nguyen Duy Ngoc said that the research will not be conducted in 2023. Over the past 5 years, there have been annual summaries and recommendations on loopholes and inadequacies in the application of the law that subjects have taken advantage of, especially in cyberspace activities and after the recent COVID-19 pandemic. Therefore, the research is carefully analyzed according to groups of criminal acts.
Concluding the discussion, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the National Assembly Standing Committee agreed with the need to amend the above four projects and basically agreed with the content of the policies proposed by the Government for the four draft laws. The dossier has been fully prepared in accordance with regulations.
The National Assembly Standing Committee requests the Government and ministries to consider and incorporate the opinions of members of the National Assembly Standing Committee, the opinions of the National Assembly Chairman, and the opinions of the National Assembly agencies in the process of drafting these draft laws. The National Assembly Standing Committee agrees to add four draft laws to the 2024 law and ordinance drafting program with the above policies.
Regarding the progress of submission to the National Assembly, the National Assembly Standing Committee agreed that the draft Law on Value Added Tax (amended) and the Law on Prevention and Combat of Human Trafficking (amended) will be submitted to the National Assembly for comments at the 7th Session and approved at the 8th Session as proposed by the Government.
For the draft Law on Chemicals (amended), submit to the National Assembly for comments at the 8th Session, and approve at the 9th Session.
Regarding the draft Law on Management of Weapons, Explosives and Support Tools (amended), submit it to the National Assembly for comments at the 7th Session, consider and approve it at the 8th Session.
During the preparation process, if the Government prepares well and brings it up for discussion at the 7th Session and receives high consensus from National Assembly deputies, the National Assembly Standing Committee will consider and coordinate with the Government to submit it to the National Assembly for approval at the 7th Session according to the procedure at a session./.
