New regulations on military ranks of Lieutenant General and Major General

This is a new point in the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army passed by the National Assembly , which does not specifically stipulate the military ranks of Lieutenant General and Major General for each position.


The Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army (VPA) was passed by the 15th National Assembly at the morning session on November 28, in the working program of the 8th Session. The Law officially takes effect from December 1, 2024.

Accordingly, the Law has the following new points:

1. No specific regulations on military ranks of Lieutenant General and Major General for each position

The previous Law on Officers of the Vietnam People's Army specified the highest military rank up to Major General.

The Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army only specifically stipulates the highest military rank as General with 3 titles (Minister of National Defense , Chief of the General Staff, Director of the General Political Department);

Senior Lieutenant General, Navy Admiral with 14 titles (Deputy Minister no more than 6, Deputy Chief of the General Staff no more than 3, Deputy Director of the General Department of Politics no more than 3); Director, Political Commissar of the National Defense Academy.

The military ranks of Lieutenant General, Vice Admiral of the Navy and Major General, Rear Admiral of the Navy are not specifically regulated for each title but only stipulate a maximum number of 398.

The Law assigns the Government to specify in detail the positions with the highest military ranks as Lieutenant General, Vice Admiral of the Navy, Major General, Rear Admiral of the Navy and the highest military ranks for positions and titles of officers are generals of newly established units, reorganized units, and units with additional functions and tasks, but not exceeding the maximum number of general-rank positions according to the decision of the competent authority.

The new law also adds a provision that the People's Army officer seconded to hold the position of Chairman of the National Assembly's Defense and Security Committee has the highest military rank of Senior Lieutenant General.

For seconded People's Army officers with positions and titles higher than those specified above and in special cases, they will be awarded or promoted to the rank of general by decision of competent authorities.

2. Add officer positions

Article 11 of the previous Law on Officers of the Vietnam People's Army only stipulates the positions of officers including:

Minister of National Defense; Chief of the General Staff; Director of the General Political Department; Director of a General Department, Director General, Political Commissar of a General Department; Commander of a Military Region, Political Commissar of a Military Region; Commander of a Military Service, Political Commissar of a Military Service;

Commander of the Border Guard, Political Commissar of the Border Guard; commander of an army corps, political commissar of an army corps; commander of an army branch, political commissar of an army branch; commander of a Navy region, political commissar of a Navy region;

Division commander, division political commissar; commander of the provincial and centrally-run city military command (collectively referred to as provincial level), political commissar of the provincial military command;

Commander of the Provincial Border Guard Command, Political Commissar of the Provincial Border Guard Command; Brigade Commander, Political Commissar of Brigade; Regiment Commander, Political Commissar of Regiment;

Commander of the Military Command of a district, town, or city under a province (collectively referred to as district level), political commissar of the Military Command at the district level; battalion commander, battalion political commissar; company commander, company political commissar; platoon leader.

The new law has added the following positions : Deputy Minister of National Defense; Deputy Chief of the General Staff; Deputy Director of the General Department of Politics; Deputy Director of the General Department, Deputy Director of the General Department, Deputy Commissar of the General Department; Deputy Commander, Deputy Commissar of: Military Region, Military Service, Border Guard, Army Corps;

Deputy division commander, deputy political commissar of division; deputy commander, deputy political commissar of provincial military command; deputy commander, deputy political commissar of provincial border guard command; deputy regimental commander, deputy political commissar of regiment;

Deputy commander, deputy political commissar of district military command; deputy battalion commander, deputy political commissar of battalion; deputy company commander, deputy political commissar of company.

3. More specific regulations on early promotion and seconded officers

The new law also provides more specific regulations on cases where officers are considered for early promotion.

Specifically, officers are considered for early promotion in case of outstanding achievements in combat or commendation in work;

Successfully complete duties and tasks for which the current military rank is two or more ranks lower than the highest military rank prescribed for the position or title the officer is holding, or the current military rank is lower than the highest military rank for the command or management position.

Officers are considered for early salary increase if they achieve outstanding achievements in combat or are commended for their work.

Seconded officers perform duties and responsibilities and enjoy benefits like officers currently working in the Army; the agency or organization where they are seconded ensures working and living conditions;

Upon completion of the secondment, the person will be considered and assigned to a suitable position; in case of assignment to a position lower than the secondment position, the benefits of the secondment position will be retained.

4. Localities are responsible for arranging land for social housing for armed forces.

The new law supplements regulations on the responsibility of local authorities in allocating land from land funds to develop social housing in accordance with the provisions of the law on housing and recovering land in accordance with the provisions of the law on land to hand over to the Ministry of National Defense as the competent authority, deciding and approving investment policies;

Select investors to implement investment projects and build social housing in accordance with the provisions of the law on housing and other relevant legal provisions in accordance with the needs of the Ministry of National Defense.

5. Increase the age of active service of officers

One of the amendments that has received the most attention is the new regulation on the age of active service for officers.

The amendment aims to increase the age of active service for officers so that officers can enjoy a pension of 75% according to the provisions of the Law on Social Insurance and the Labor Code.

Previously, the maximum age limit for officers serving in the army at the rank of Lieutenant was 46 years old; Major was 48 years old, Lieutenant Colonel was 51 years old, Senior Colonel was 54 years old, male Colonel was 57 years old, female Colonel was 55 years old; General rank for men was 60 years old, female was 55 years old.

According to the new regulations, the maximum age limit for officers serving in the army at the rank of Lieutenant is 50 years old (increased by 4 years); Major is 52 years old (increased by 4 years); Lieutenant Colonel is 54 years old (increased by 3 years); Senior Colonel is 56 years old (increased by 2 years);

Colonel is 58 years old (increase 1 year for men, 3 years for women); general is 60 years old (remains the same for men, increases 5 years for women).
