The Road Law 2024, which will come into effect on January 1, 2025, introduces a number of new regulations to enhance management and ensure safety in the road transport sector. Below are some key points related to the transport of passengers and goods by car.

1. Regulations on passenger transport by car
According to Article 57 of the 2024 Road Law, passenger transport businesses by car must comply with a series of new responsibilities to ensure safety and service quality. Specifically:
- Operation and control of transport activities: Units must manage vehicles, drivers, and decide on passenger transport fares. This is to ensure transparency and reasonableness in service provision.
- Health check-ups for drivers: Transport businesses are responsible for organizing regular health check-ups for drivers and ensuring they meet the health requirements as prescribed by law.
- Announce service quality standards: Business units must publicize service standards so that passengers can evaluate and choose suitable services.
- Application of information technology: Applying technology to manage and provide data on transport activities is a mandatory requirement to increase transparency and efficiency in operations.
In addition, business entities shall also be responsible or jointly liable for violations committed by employees or representatives, if such violations arise from complying with requests of the business entity contrary to the law.
The Law also emphasizes that passenger transport must comply with Article 56, to ensure order and safety of road traffic according to current regulations.
2. Regulations on transporting goods by car
Article 61 of the 2024 Road Law clearly stipulates the transportation of goods by car. One of the important requirements is the use of a bill of lading, which is a document confirming the quantity, type and condition of the goods before transportation. This is legal evidence of the contract of goods transportation.
- Managing freight transport activities: Freight transport businesses by car must operate vehicles, drivers, and decide on appropriate fares.
- Health check and use of qualified drivers: Similar to passenger transport, freight transport businesses must also ensure that drivers are in good health according to the law.
- Application of information technology: Application of technology in management and provision of data on transportation activities is a requirement to improve management efficiency and minimize risks during transportation.
- Responsibility of business units: Business units must be responsible or jointly responsible for violations of employees or representatives during the transportation of goods, if these violations violate legal regulations.
The 2024 Road Law also requires that when transporting goods by road, drivers must have a valid transport document. This is to ensure transparency and control over the goods transportation process.
Support from Provincial People's Council
The 2024 Road Law also empowers provincial People's Councils to decide on support policies related to public passenger transport. Specifically, bus investment projects and infrastructure construction for public passenger transport can receive interest rate support from credit institutions. In addition, users of public passenger transport services by bus can enjoy fare exemption and reduction policies.
Effective Date
The 2024 Road Law will officially take effect from January 1, 2025, except for some special provisions that will take effect earlier on October 1, 2024. At the same time, the 2008 Road Traffic Law will expire when the 2024 Road Law comes into effect, except for cases specifically provided for in Article 86 of this Law.
With these important changes, the Road Law 2024 will bring about significant improvements in the management and operation of road transport, thereby improving service quality and ensuring traffic safety nationwide.
