The Ministry of Public Security said that Decree No. 10/2020/ND-CP dated January 17, 2020 (amended and supplemented by Decree No. 47/2022/ND-CP dated July 19, 2022) of the Government regulating business and conditions for business of automobile transportation stipulates:
Clause 2, Article 3 stipulates that automobile transportation business is the performance of at least one of the main stages of transportation activities (directly operating vehicles, driving or deciding on transportation fares) to transport passengers and goods on the road for profit purposes.
Clause 6, Article 7 specifically regulates passenger transport business units under contract, drivers transporting students, staff and workers to school and work. Accordingly, before implementing the contract, the transport business unit must notify once the minimum contents of the contract specified in Clause 2 (except points e and g) Article 15 of this Decree, including:
Information about the transport business unit signing the contract: Name, address, phone number, tax code, representative signing the contract; Information about the driver: Full name, phone number; Information about the passenger or the transport hirer (organization or individual): Name, address, phone number, tax code (if any); Information about the vehicle: Vehicle registration plate and capacity (tonnage); Information about the contract performance: Time of contract start and end (day, hour); address of the starting point, address of the ending point and pick-up and drop-off points (or loading and unloading of goods) on the transport route; distance of the transport route (km); number of passengers (or volume of goods transported).
At the same time, it is necessary to notify again when there is a change in the itinerary, transportation time or stops, pick-up and drop-off points; transport the right subjects (students, staff going to school, going to work) and not having to perform the contents specified in Point c, Point d Clause 3, Point b, Point c Clause 4 and Clause 5 of this Article.
