The land use structure of the project includes: Residential land; resort villa land; urban service land; tourism service land; land for trees, water surface and technical infrastructure and traffic land.
After adjusting the planning, the project is divided into two sub-areas, including: land for building townhouses with gardens and traffic land, land for trees and water surface, land for tourism and urban services. The population size of the project also increased.
On January 26, 2007, Dong Nai Provincial People's Committee issued Document No. 731/UBND-CNN approving the project investment policy.
On March 26, 2009, the project was granted Investment Certificate No. 47121000196 and amendments and supplements by the Provincial People's Committee. On December 17, 2018, the People's Council of Dong Nai province issued Resolution No. 145/2018/NQ-HDND on approving the list of land acquisition projects, projects using rice-growing land, protective land, and special-use forests in 2019 of Dong Nai province; including the Dong Nai River Eco-tourism Urban Area project. The project is also included in the 2020 land use plan of Nhon Trach district, approved by the People's Committee of Dong Nai province in Decision No. 4377/QD-UBND dated July 31, 2019.
On July 14, 2021, the People's Committee of Dong Nai province issued Decision No. 2404/QD-UBND on approving land prices to calculate compensation when the State recovers land to implement the project with an area valued at about 21.8 hectares including rural residential land and agricultural land in Dai Phuoc commune (Nhon Trach district). This Decision is implemented based on Document No. 4387 dated July 5, 202 of the Dong Nai Provincial Land Valuation Council on the method of calculating specific land prices of the project and considering the proposal of the Director of the Provincial Department of Natural Resources and Environment.
On December 17, 2021, Nhon Trach District People's Committee issued Decision No. 5009/QD-UBND on approving the compensation, support and resettlement plan for the project.
According to the people, the project includes villas, townhouses and commercial buildings for sale and lease for profit; there is only a small area for building social housing, so this can be considered a commercial project. It is known that current laws have very clear regulations on public announcement of construction planning.
Specifically, the 2014 Construction Law stipulates: No later than 15 days from the date the planning is approved by the competent authority, the construction planning project must be publicly announced. The announced content includes the entire content of the construction planning project and management regulations according to the issued construction planning project, except for contents related to national defense, security, and state secrets.
The construction planning management agency is responsible for fully updating the implementation status of the approved construction planning project so that the competent authority can promptly publicize it to organizations and individuals and supervise the implementation process. The person responsible for announcing the construction planning who fails to announce, announces late, or announces incorrect contents of the approved construction planning shall, depending on the nature and severity of the violation, be subject to disciplinary action or criminal prosecution. If damage is caused, compensation must be paid in accordance with the provisions of law.
Clause 3, Article 114 of the Land Law requires that land price determination must be carried out as follows: The determination of specific land prices must be based on investigation, collection of information on land plots, market land prices and information on land prices in the land database; applying appropriate land valuation methods. Based on the results of land price determination consultation, the provincial land management agency shall submit to the Land Price Appraisal Council for consideration before submitting to the People's Committee of the same level for decision.
