The above content was stated by the Ministry of Education and Training in công văn 1581 sent to the People's Committees of provinces and cities regarding ensuring the maintenance and improvement of the quality and effectiveness of school operations when implementing the new government model, abolishing district-level units.

Accordingly, after the reorganization and restructuring of the government at all levels, the Department of Education and Training is delegated the following functions and tasks related to teacher management:

- Advise and submit to the Provincial People's Committee and competent authorities for decision on job positions, civil servant staffing, and the total number of employees at public schools.

- The Department of Education and Training is responsible for the recruitment, employment, appointment, change of professional titles, training, professional development, and evaluation of teachers, education administrators, and staff in public schools.

- The Department is also responsible for developing plans for the recruitment, employment, training, and professional development of teachers in localities and schools throughout the province.

- Ensure sufficient staffing levels for management positions and the number of employees as approved by the Provincial People's Committee. Simultaneously, be accountable for the operation and quality of education , the teaching staff, employees, and students.

- The Department of Education and Training has the authority to recognize, appoint, dismiss, transfer, and change the job positions of principals and vice-principals of schools.

- The Department is responsible for regularly updating information on teachers and administrators into the national education database and other management levels such as the Provincial People's Committee and the Ministry of Education and Training.

Previously, the recruitment of public school teachers was carried out like the recruitment of civil servants in general, by the Ministry of Interior and the People's Committees at the district/provincial level.

Thus, in the coming period, the function of recruiting teachers at all levels will be more strongly decentralized and empowered to the Departments of Education and Training in localities (except for preschools, where recruitment will be decided by the commune). This can be considered one of the breakthrough decisions of the education sector, expected to solve the problem of localized teacher shortages and surpluses in localities and to properly utilize talented individuals in schools.

This new decision also aligns with the content of the draft Law on Teachers, which is currently being considered by the National Assembly at its 8th session (October 2024) and the upcoming 9th session.

Accordingly, the authority to recruit teachers in public schools rests with the education management agency or is delegated to the educational institution.

For schools with autonomy, the principal is responsible for recruitment. For private schools, recruitment is overseen by the school itself, in accordance with its organizational and operational regulations.

The draft also stipulates that the transfer, placement, and appointment of teachers are the responsibility of the education management agencies, which will advise, decide, or recognize them according to their assigned authority.

Professor Thai Van Thanh, Director of the Department of Education and Training of Nghe An province, believes that assigning responsibility and autonomy in teacher recruitment and utilization to local Departments of Education and Training can address difficulties and limitations such as: the current number of teachers at all levels is insufficient compared to the quotas stipulated by the Ministry of Education and Training; the teacher structure is not rational, with localized surpluses and shortages in some subjects at the primary, secondary, and high school levels due to the implementation of the new general education program...

To ensure truly effective recruitment in the future, Professor Thai Van Thanh proposed that the Ministry of Education and Training and the People's Committees of provinces and cities regulate the content, form, and requirements for recruitment conditions and standards specifically for teachers, to ensure suitability with the profession's unique characteristics, minimize administrative and official duties, and strengthen requirements and assessments of pedagogical competence.
