What did the Ho Chi Minh City Department of Culture and Sports say about Dam Vinh Hung going to the US to sing despite being banned from performing?

The Department of Culture and Sports of Ho Chi Minh City said there are no sanctions against singer Dam Vinh Hung being invited by foreign organizations and individuals to sing abroad.

In recent days, the news that singer Dam Vinh Hung will perform in a music show in the US on November 27 has attracted the attention of the audience. Many people wonder if the singer's performance abroad will violate the 9-month suspension decision that he is currently serving.

Recently, the Department of Culture, Sports and Tourism of Ho Chi Minh City has responded to this incident, based on the following grounds: Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government regulating administrative sanctions in the fields of culture and advertising; Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees regulating administrative sanctions in the fields of tourism; sports ; copyright, related rights; culture and advertising; Decree No. 128/2022/ND-CP dated December 30, 2022 of the Government amending and supplementing a number of articles of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government regulating administrative sanctions in the fields of culture and advertising has been amended and supplemented by Decree No. 129/2021/ND-CP dated December 30, 2021 of the Government amending and supplementing a number of articles of the Decrees regulating administrative sanctions in the fields of tourism; sports ; copyright, related rights; culture and advertising.

Accordingly, at Point a and Point b, Clause 1, Article 2 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government, it is stipulated that the subjects of application are: Vietnamese organizations and individuals committing administrative violations in the field of culture and advertising in Vietnam and abroad; Foreign organizations and individuals committing administrative violations in the field of culture and advertising in the territory of Vietnam. In addition, Decree No. 38/2021/ND-CP stipulates the handling of organizations and individuals using performers during the period of suspension of performing activities by competent state agencies to organize artistic performances as prescribed in Clause 4, Article 11 of Decree No. 38/2021/ND-CP. There are no provisions on handling performers during the period of suspension of performing activities by competent state agencies.

"Therefore, Mr. Huynh Minh Hung (singer Dam Vinh Hung) was invited by foreign organizations and individuals to sing abroad (not in Vietnam's territory), so there are no sanctions for this case," said a representative of the Department.

Previously, singer Duong Trieu Vu posted an announcement about a show on Thanksgiving, taking place on November 27 in the US. The show will feature singers Duong Trieu Vu, Dam Vinh Hung, Nhu Quynh, Nguyen Hong Nhung... The male singer also shared: "Dam Vinh Hung and I will be present at the upcoming show. We are preparing very special, wonderful performances that have never been performed before to send to the audience". Information about the music night was also announced by the organizers on the poster, including a list of performing singers, time and location of the show.

Singer Trizzie Phuong Trinh also shared photos and videos of Dam Vinh Hung singing at a birthday party held in the US on November 3 (US time). The female singer said the audience was surprised and excited when the male singer went on stage to sing nearly 20 songs, from hits to bolero and new wave music.

In July 2024, the Vice Chairman of the Ho Chi Minh City People's Committee signed a decision to administratively fine Dam Vinh Hung VND 27.5 million. In addition, the male singer was subject to an additional penalty of 9-month suspension from performing activities according to the provisions of Point b, Clause 9, Article 11 of Decree No. 38/2021/ND-CP dated March 29, 2021 of the Government.

The penalty decision also stated that Dam Vinh Hung violated the law because "performing arts using costumes, words, sounds, images, movements, means of expression, and forms of performance that are contrary to the nation's traditions and customs; negatively affecting morality, public health, and social psychology."
