
Creating an inter-sectoral legal system on digital transformation
The draft Law on Digital Transformation was presented by Deputy Minister of Science and Technology Vu Hai Quan. Accordingly, the development of the law is necessary to complete the legal system on national digital transformation, create an inter-sectoral legal system on digital transformation in industries and fields. At the same time, it regulates the relationship between entities participating in activities in the digital environment; promotes the comprehensive digital transformation process; strengthens international cooperation and integration.
The draft Law is expected to consist of 8 Chapters and 79 Articles, regulating digital transformation, including: infrastructure for digital transformation; digital government and digital transformation of operations of agencies in the political system; digital economy; digital society and measures to ensure digital transformation.

The Draft Law also affirms the State's major policies, identifying digital transformation as a top breakthrough; taking people as the center; prioritizing the development of digital infrastructure, data, human resources and promoting international cooperation as stated in documents such as Resolution No. 57-NQ/TW dated December 22, 2024, Resolution No. 71/NQ-CP dated April 1, 2025...
Prohibited acts stipulated in the draft Law are expected to include: taking advantage of digital transformation to violate security, illegally disseminate data, interfere with or sabotage digital systems and digital data; violating personal data protection, obstructing legal digital transformation, manipulating users via digital platforms; using digital transformation technology to commit fraud and engage in unfair competition...
Regarding digital society, this Chapter stipulates the contents to manage and promote the development of digital society: Basic principles of digital society development; ensuring the rights and legitimate interests of citizens in the digital environment; popularizing digital language; promoting integration in the digital environment; protecting children; cultural behavior in the digital environment; mechanisms for managing, monitoring and measuring digital society.

Clearly define the scope of regulation, ensuring no overlap or duplication
The review report presented by Deputy Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan stated that the Committee agreed with the necessity of promulgating the Law on Digital Transformation.
However, it is recommended that the drafting agency continue to review and compare the draft Law with relevant laws in areas such as investment, bidding, state budget, etc.; at the same time, closely coordinate with the drafting agencies of the draft Laws being submitted to the National Assembly for consideration and approval at the 10th Session of the 15th National Assembly to ensure consistency in the legal system.

Regarding the scope of regulation of the Law (Article 1), the Committee requests the drafting agency to clearly define the position and role of the Law on Digital Transformation in the legal system; clarify the relationship between the draft Law and laws directly related to digital transformation activities such as the Law on Electronic Transactions, the Law on Identification, the Law on Data, Resolution No. 193/2025/QH15, the Law on Digital Technology Industry, the Law on Personal Data Protection, thereby clearly defining the scope of regulation associated with specific management objectives, ensuring no overlap or duplication.
Regarding digital society (Chapter V), it is recommended to study and supplement specific regulations on the order and procedures for notifying the basic operating principles of algorithms in cases where such algorithms have a direct impact on the rights and legitimate interests of citizens (Clause 5, Article 50); consider supplementing regulations assigning the Government to specify in detail the order, procedures, and competent authorities to resolve so that people can exercise their rights in the digital environment.
The majority of members of the National Assembly Standing Committee approved the promulgation of the draft Law on Digital Transformation in the context of digital transformation taking place nationwide, not only in ministries, branches, and central management agencies but also very strongly in localities.

Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that the draft Law has demonstrated the spirit of inheriting the reasonable contents of the Law on Information Technology; at the same time, adding new regulations in line with modern technology trends such as: artificial intelligence, big data, internet of things, blockchain and digital copies.
In addition, the drafting agency also consulted the digital government framework along with international laws of the EU, Japan, Korea, etc., thereby helping the draft Law approach advanced standards, creating a legal foundation, promoting comprehensive digital transformation with the spirit of taking people and businesses as the center, towards a sustainable digital economy and digital society.

Chairman of the Law and Justice Committee Hoang Thanh Tung suggested continuing research and review to clearly determine the position of the Law on Digital Transformation in the legal system; paying attention to distinguishing the subjects of regulation of the draft Law from specialized laws and laws regulating the fields of science, technology and innovation that have just been passed by the National Assembly to clarify the scope of regulation and avoid overlaps and duplications.
Concluding the session, Vice Chairman of the National Assembly Le Minh Hoan stated that the National Assembly Standing Committee proposed that the Government direct, conduct additional research, continue to thoroughly grasp and review, and fully institutionalize the policies, guidelines, resolutions, and conclusions of the Party Central Committee and the Politburo to remove bottlenecks, promote development, and create breakthroughs in digital transformation.
Carefully review regulations related to digital transformation in the system of legal documents, do not re-regulate or refer to previous legal documents to avoid conflicts, overlaps or increase legal compliance costs...
The Vice Chairman of the National Assembly assigned the Standing Committee of the Science, Technology and Environment Committee to complete the verification report to submit to the National Assembly at the 10th Session.
