Federal Judge Alia Moses in Del Rio, Texas, on October 30 banned the Biden administration from cutting or removing barbed wire fences until at least November 13, according to Reuters. The ban will be in effect while Moses considers a lawsuit filed by Texas Attorney General Ken Paxton, a Republican, accusing the federal government of illegally destroying state property.
In the lawsuit, Mr. Paxton said federal agents used heavy machinery to tear down large sections of the border fence, allowing illegal immigrants to flood into the United States.
Gov. Greg Abbott called the court ruling a victory for Texas and the state's border mission. He accused President Biden of "creating this crisis and trying to shut down" the state.
The Department of Homeland Security says it has a responsibility to act when a situation puts its personnel or immigrants at risk.
The barbed wire fence was built by the Texas National Guard on private land as part of an operation launched by Governor Abbott in 2021 to prevent illegal border crossings.
A federal judge ordered the 305-meter (1,000-foot) barrier removed in September at the request of the Biden administration, but an appeals court later ordered it to remain in place while Paxton appealed. Texas is also suing for the right to install floating barriers in the middle of the Rio Grande at the border to deter immigrants.
Since President Biden took office in January 2021, the number of illegal immigrants entering the US has increased to a record level, according to RT. The US Border Patrol detected nearly 2.48 million illegal immigrants in fiscal year 2023 (ending September 30), up 4.1% compared to the previous 12 months. In the last fiscal year that Donald Trump was in office, the above figure was only 458,000 people.
